Fashion Nova has agreed to a $5.15 million class action lawsuit settlement to resolve claims that its website is not compatible with screen-reading software for the blind.
The Fashion Nova settlement benefits a nationwide and California subclass of legally blind individuals who have attempted to access Fashion Nova’s website using screen-reading software since Feb. 26, 2018.
According to the Fashion Nova class action lawsuit, the retailer’s website is not compatible with screen-reading software for the blind and vision-impaired. As a result, blind individuals are allegedly denied an experience equivalent to that of sighted individuals.
Fashion Nova, an online clothing retailer, has not admitted any wrongdoing but agreed to a $5.15 million class action settlement to resolve the accessibility allegations.
Under the terms of the Fashion Nova settlement, only California class members are eligible to receive a cash benefit. The exact amount of each payment will vary depending on the number of class members who make approved claims.
If the net settlement amount is sufficient, each subclass member will receive $4,000. If the net settlement amount is not sufficient to pay $4,000 to all approved claims, the settlement administrator will divide the net settlement amount equally among all approved claims, resulting in lower payments.
The deadline for exclusion and objection is Oct. 20, 2025.
The final approval hearing for the Fashion Nova class action lawsuit settlement is scheduled for Feb. 12, 2026.
To receive settlement benefits, class members must submit a valid claim form by Oct. 20, 2025.

Legally blind individuals who have attempted to access Fashion Nova’s website with screen-reading software since Feb. 26, 2018.

An Evidentiary hearing was held on March 30, 2026 with the matter still under review and a final settlement decision still to be made.
The DOJ did issue a Statement of Interest for this case dated 2/2/26 before the final hearing. The statement stated that it sees this case “principally to enrich class counsel” and not to properly benefit those with disabilities such that the settlement is not “fair, reasonable, and adequate” along with a recommendation that “the Court should reject it.” Additionally, it was incorrectly stated previously in these comments that “the court issued their Final Approval on 2/12/26” which was incorrect as it seems no ruling has yet been made.
