Bank of America

A settlement has been reached in a class action lawsuit over allegedly excessive force-placed insurance policies. If you were charged by Bank of America or Countrywide Home Loans for a lender-placed hazard insurance policy, you may be entitled to benefits from the class action settlement.

The Bank of America class action lawsuit involves lender-placed insurance, which is placed on a homeowner’s property to protect the borrower and mortgage lender when the homeowner’s insurance policy lapses, or if the homeowner does not maintain an insurance policy that is acceptable to the mortgage lender. The plaintiffs allege that Bank of America and Countrywide would force-place insurance policies so that they received an unauthorized benefit and received additional commissions from the insurer. This practice allegedly resulted in homeowners being forced to pay excessive rates for the insurance policies.

The defendants deny the allegations but agreed to settle the force-placed insurance class action lawsuit to avoid the expense and risk of trial.

If you were charged by Bank of America NA, Banc of America Insurance Services Inc., BAC Home Loans Servicing LP or Countrywide Home Loans Servicing LP a premium for lender-placed hazard insurance coverage issued by Balboa Insurance Company, Meritplan Insurance Company, Newport Insurance Company or one of their affiliates on your residential property, you may be eligible for benefits from the force-placed insurance class action settlement.

Yes, I just received mine for $4.42.

  2. Robert says:

Finally got a check. a big whopping $25.80… but I see that is more than some got. and as some one said B of A wins as usual. Good luck with your loan modification, I applied twice last year for one and was rejected the first time, and the second time, they were so generous by reducing it $100.

  3. LIP says:

I received a check for $1,205. This was for 4 years of LPI and they were charging me over $6,000 a year (for insurance that was about $2,100 a year).

DOES ANYONE ELSE HAVE A CHECK THAT HAS THESE WORDS ON THE BOTTOM OF THE CHECK? “This check may not be cashed at a check cashing agency or a money service business.” What is that all about? You had to fill out a CLAIM FORM FOR EACH POLICY. So if you had 3 years worth of FPI you had to file 3 claims. The forms they sent out had policy numbers listed on them but it did not say that that is what you had to do. I sort of put 2 and 2 together and went ahead and sent in 4 claim forms.
