ESO Solutions agreed to pay more than $4.1 million to resolve allegations it violated Illinois biometric privacy laws in connection with its eCore Solutions ePro BioClock.

The eCore Solutions settlement benefits individuals who scanned their finger to use an ePro BioClock in Illinois and whose finger-scan data was hosted on a server ESO Solutions owned or leased between Jan. 24, 2017, and Sept. 10, 2024.

According to plaintiffs in the case, ESO Solutions Inc. violated the Illinois Biometric Information Privacy Act by failing to obtain informed consent from individuals before collecting their biometric data. The BIPA class action lawsuit also claims the company failed to provide adequate notice of the data collection or implement reasonable safeguards to protect the data it unlawfully collected.

ESO Solutions is a technology company that provides software solutions for emergency medical services and other health care organizations.

ESO Solutions hasn’t admitted any wrongdoing but agreed to pay more than $4.1 million to resolve the BIPA class action lawsuit.

Under the terms of the eCore Solutions settlement, class members can receive an initial cash payment estimated at around $401. If funds remain in the settlement after this initial round of payments, class members who cashed their first check may receive a pro rata second check of at least $5. Second payments will vary depending on the number of eligible class members and the amount left in residual funds.

If the residual funds do not warrant a second round of payments, this money will be donated to the Electronic Privacy Information Center and Illinois Heart Rescue as cy pres beneficiaries.

The deadline for exclusion and objection is Dec. 2, 2024.

The final approval hearing for the settlement is scheduled for Jan. 14, 2025.

No claim form is required to benefit from the BIPA settlement. Class members who do not exclude themselves will automatically receive settlement payments.
