The 3M Co., Georgia-Pacific LLC, and Georgia-Pacific Consumer Products LP have agreed to a $11.9 million settlement benefiting those whose properties serviced by the Parchment, Michigan, Water System potentially were exposed to per and polyfluoroalkyl substances (PFAS), leading to PFAS water contamination.

The Class is made up of anyone who owned, leased, rented, or resided in homes or residential properties serviced by the Parchment Water System as of July 26, 2018, and has not brought an individual action for personal injury or illness based on exposure to PFAS water contamination in the system.

A class action lawsuit filed in June 2019 alleged the Georgia-Pacific defendants were responsible for dumping waste containing PFAS into the Crown Vantage Landfill, which they maintained; 3M was accused of manufacturing the chemicals despite knowing about their toxicity.

The PFAS water contamination allegedly reached the Parchment Water System, and, therefore, Class Members’ properties.

PFAS exposure may lead to altered metabolism, fertility problems, and an increased risk of obesity and cancer.

The Court did not rule in favor of either party; rather, the parties agreed to the settlement in order to avoid the ongoing risks and costs associated with continuing litigation.

3M manufactures a wide range of products, from tape and personal protective equipment to coatings, cleaning supplies, and insulation.

Georgia-Pacific LLC, which has more than 180 locations and 30,000 employees worldwide — manufactures building materials, such as wall panels, composite panels, roof boards, and more.

If the settlement is approved, Class Members who file a valid claim will receive a portion of the settlement fund after attorneys’ fees and other deductions are made.

Individual Class Members’ payments will be based on whether they owned, leased/rented, and/or resided in homes serviced by the Parchment Water System. 

Those who owned or rented/leased one or more residential properties that they also occupied will be entitled to two times the amount they paid to either those who owned or rented/leased such properties but did not reside in one or who resided in such a property but were not its owner, renter, or lessee. 

Only one person can be designated as a single property’s owner, renter, or lessee; otherwise, the property’s share will be divided between all Class Members claiming such an interest in the property.

A final hearing in the Parchment PFAS water contamination settlement will be held Sept. 1, 2021.

Those who would like to opt out of or object to the settlement must do so by July 12, 2021.

The deadline to file a claim is July 26, 2021.

Who’s Eligible

Anyone who owned, leased, rented, or resided in homes or residential properties serviced by the Parchment Water System as of July 26, 2018, and has not brought an individual action for personal injury or illness based on exposure to PFAS present in the system.

  • Individual Class Members’ payments will be based on whether they owned, leased/rented, and/or resided in homes serviced by the Parchment Water System. 
Proof of Purchase

Claimants must submit a copy of a government-issued photo identification to establish your identity and current address.

Those who owned property serviced by the Parchment Water System must include a copy of their deed or a mortgage statement, a tax bill, or a tax statement.

Those who rented or leased a property serviced by the Parchment Water System must attach a copy of a lease, utility bill, or other similar document that includes the Class Member’s name and the qualifying property’s address.

    I was never made aware of this lawsuit. I lived in Parchment for 18 years in a rental home. Never received a letter or anything. Moved from Parchment in 2018 and in 2019 was diagnosed with kidney failure. I would like to see who received my letter. Pfas was found at the end of my road in the water system.
