A settlement was reached with Citizens Bank to resolve allegations that the financial institution placed cell phone calls to individuals via an automatic telephone dialing system or artificial or prerecorded voice message without prior consumer consent, in violation of the TCPA.
The TCPA, also known as the Telephone Consumer Protection Act, was instituted in 1991 to protect consumers from unwanted solicitations and telemarketing calls and the use of automated telephone equipment.
Restrictions are placed on businesses who call consumers or businesses, send text messages and faxes.
If a business violates the TCPA, a plaintiff may seek statutory damages for up to $500 for each violation, and for willful violations the amount can be trebled for up to $1,500.
Plaintiff Linda Sanders filed the lawsuit against Citizens Bank alleging that she received a number of phone calls on behalf of Citizens Bank that were placed to her cell phone and that were made by a robocall system.
Citizens Bank has continued to deny any wrongdoing, and says it did not violate the TCPA nor did it use an automatic telephone dialing system or an artificial or prerecorded voice to place cell phone calls to individuals without their prior consent.
In this settlement, the court did not decide in favor of one party or the other. Rather, the TCPA settlement was reached as a result of a compromise on both sides.
The settlement allows the plaintiffs in the Class to receive speedy compensation while avoiding the risks, costs and delays of a trial.
The settlement provides a total of $4.5 million to compensate eligible Class Members, pay attorneys’ fees and costs, provide a service award to the Class Representative and to pay the claims administrator.
After the relevant fees, costs and awards are paid, the remainder of the settlement will be divided equally among the members of the settlement Class. It is estimated that there are approximately one million individuals that are included in the settlement Class.
According to an earlier news story covering the Citizens Bank Settlement, it was reported that if one percent of the eligible claimants filed an eligible claim, the approximate payout would be approximately $280.
While this is less than the $500 per violation allowed under TCPA, the Class Representative and class counsel felt this was a fair deal in order to receive timely payment and avoid any risks associated with further litigation.
Who’s Eligible
The TCPA settlement includes all individuals in the U.S. who received a cell phone call from Citizens Bank (or from those calling on behalf of Citizens Bank) that was made using an alleged automatic telephone dialing system and/or an artificial or prerecorded voice during the Class period of Dec. 20, 2009 through July 31, 2015.

Recieved S62.40 today.
I received 2 checks @ $62.40 and my husband received 2 checks @ $62.40. Not bad for 2 minutes of work filling out.
