Equilon Enterprises LLC, d/b/a Shell Oil Products US, has agreed to settle a class action lawsuit alleging it falsely advertised its Ski Free® promotion at certain Shell-branded stations.

The class action lawsuit was launched in February 2014 and claims that Shell’s practice of providing two-for-one vouchers instead of one free ski lift ticket was a breach of contract.

Specifically, the advertisement at issue was part of Shell’s Ski Free® promotion, and according to the lead plaintiffs John Martin Kearney of Oregon, Carly LaForest and Alysia Rowe of Michigan, Richard Schempp of California, and Jeffrey Paul Gilpin Jr. of Washington, they and other customers were promised that if they purchased 10 gallons of fuel, they would receive a voucher for a free lift ticket.

In reality, once customers purchased ten gallons of fuel, they received a “two for one” coupon that allowed applicable consumers the right to obtain a free lift ticket only after purchasing a lift ticket at full price at a participating ski resort.

Additionally, the group of consumers claim that the terms and condition were not properly disclosed and that the vouchers contained a variety of date, time, resort, and other limitations, and that Shell’s advertising of the Ski Free® promotion violated various state consumer protection laws as well as gave rise to common law causes of action for breach of contract.

Under the terms of the Shell Ski Free® class action lawsuit settlement, the company will pay $2.2 million to settle the litigation and is required to revise the marketing for the Ski Free® promotion to inform consumers that it is a buy one, get one free offer and is “subject to restrictions or blackouts.”

Any money remaining in the $2.2 million settlement fund after Class Members and other expenses (including attorneys’ fees, incentive awards, administrative costs) are paid will be distributed to the Better Business Bureau Center and AARP Foundation in the form of a cy pres award.

Shell denies all of the allegations made in the class action lawsuit.

Class Members who wish to object or opt out of the Shell Ski Free class action settlement, must do so no later than Oct. 6, 2016.

Who’s Eligible

Under the terms of the Equilon Ski Free Voucher Class Action Lawsuit Settlement, all persons in the states of California, Michigan, Oregon, and Washington who purchased 10 or more gallons of fuel at a Shell-branded station that offered the Ski Free promotion, and received a Ski Free voucher at the time the purchase was made, are eligible to join the class action settlement.

The Class Period begins on Nov. 1, 2009 and ends on Oct. 25, 2016, pending final approval.

Potential Award

$40. 

Eligible Class Members may receive up to $40 in total compensation. Each Class Member is entitled to only one claim.

N/A.  You must provide the address of the Shell station where you made your purchase.
