URS class action settlement

United Recovery Systems LP has agreed to settle a class action lawsuit that accuses it of violating the Fair Debt Collections Practices Act (FDCPA). If you received at least one letter from URS between Dec. 4, 2013 and May 22, 2015, you may be entitled to a cash payment from the FDCPA class action settlement.

Plaintiff Susan Ebner filed the FDCPA class action lawsuit, which alleges that United Recovery Systems engaged in prohibited debt collection practices by mailing letters that contained information in addition to the recipient’s name and address, which was visible through the envelope’s glassine window.

This conduct allegedly violates the laws of Pennsylvania, New Jersey, Delaware and the U.S. Virgin Islands.

Ebner claims that she received a letter from United Recovery Systems in which a “URS No.” or a QR box or barcode with that information was visible.

According to the URS class action lawsuit, exposing this information in a debt collection mailing constitutes a violation of the FDCPA.

United Recovery Systems denies the allegations and asserts that there was no exposure of information that could result in the compromise of any Class Member’s identity, Social Security number and/or financial data visible through the mailing envelope.

However, URS has agreed to settle the FDCPA class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who wish to opt out of the United Recovery Systems settlement must do so no later than July 18, 2016.

If you wish to object to the URS class action settlement, you must submit your objection and any supporting documents no later than Aug. 16, 2016.

Who’s Eligible

Class Members of the United Recovery Systems FDCPA settlement include anyone located in Pennsylvania, New Jersey, Delaware or the U.S. Virgin Islands (according to their last known address in URS’s records) who received one or more letters from URS that displayed identifying information other than the recipient’s name and address through the envelope’s glassine window between Dec. 4, 2013 and May 22, 2015.

Potential Award

Up to $1,000. The amount of compensation each Class Member will receive depends on the total number of valid and timely claims that are filed.

The minimum payment a Class Member may receive is approximately $2.68 and the maximum is $1,000.
