HireRight has agreed to settle a class action lawsuit that accused the agency of violating the Federal Consumer Reporting Act (FCRA).
According to the plaintiffs, HireRight “routinely and systematically” violates federal law by including information on background checks that negatively impacts eligibility for employment without providing a “full” copy to the consumer.
The class action lawsuit further accused HireRight of reporting on “old charges” that were dismissed by the court to employers despite the FCRA prohibition of such inclusion.
Even upon request, plaintiffs say that HireRight excluded the full background report including email communications it had with employers regarding the applicants eligibility.
Those Class Members who want to be excluded (or opt out) from the class action settlement must do so by Aug. 9, 2016.
Who’s Eligible
The HireRight class action settlement is open to three different groups of Class Members:
- Two Year Claims – “All individuals in the Settlement Class for whom HireRight’s records indicate that the request was made on or after May 23, 2011 and for whom HireRight’s records do not indicate the scope of the request”
- Two Year Available Request Claims – “All individuals in the Settlement Class for whom HireRight’s records indicate that the request was made on or after May 23, 2011 and that the request was for ‘all reports,’ ‘full file,’ or ‘the last 3 years’”
- Five Year Claims – “All individuals in the Settlement Class for whom HireRight’s records indicate that the request was made between May 23, 2008 and May 23, 2011”
Potential Award
up to $200.
The amount each Class Member receives will depend on the number of total claims submitted with a maximum payout of $200.

Class Members must submit a valid Claim Form by Aug. 9, 2016 to receive benefit from this settlement.

I just lost a very good job, due to Hire right reporting a charge from 1997 and another charge that was dismissed in 2010, now I am out of a job because of them. I need help.
I just received a letter in the mail today about this lawsuit.. years after. Wow!! It’s February 10, 2018.
