Equifax has agreed to pay $3 million to settle a class action lawsuit over accusations that the consumer credit reporting agency violated the Fair Credit Reporting Act.
Plaintiffs Donna Soutter, Brenda Arnold, and Joyce Ridgley filed the Equifax class action lawsuit in 2010 claiming that Equifax systemically failed to include records that Virginia General District Court judgments had been “satisfied, vacated, dismissed, or appealed in its credit reports,” thereby violating federal law.
The Equifax class action settlement offers Class Members four years of free credit monitoring or a one-time cash payment of $180.
Equifax denies the allegations and all liability, yet agreed to the terms of the settlement to avoid the burden, risk and expense of further litigation.
UPDATE: The Equifax class action settlement was granted final approval on Apr. 5, 2016.

Who’s Eligible
Equifax settlement Class Members include all U.S. consumers whose Equifax File contained a Virginia General District Court civil judgment, between Jan. 1, 2003 and the date of preliminary approval of the settlement.
Potential Award
$180 or four years of credit monitoring (valued at $717)
The Equifax class action settlement offers all Class Members four years of free credit monitoring without doing anything. Individuals who would rather give up the credit monitoring, can file a Claim Form and request a cash payout of $180.

Class Members who want to receive four years of credit monitoring don’t have to do anything to receive the benefits from this settlement. However, those who want to exchange monitoring for a one-time cash payout, must submit a valid Claim Form no later than May 13, 2016.
