Details: This settlement isn’t an easy one to submit your claim for. Unfortunately you’ll have to submit a paper claim and documentation. Head over to the Settlement Administrator website and click on “Eligibility is my furnace covered.” You will be required select the manufacturer of your furnace, then answer if your furnace was manufactured prior to 2001. Please note, only furnaces manufactured prior to 2001 are covered by this settlement. Next, you have to identify whether your furnace is a horizontally mounted. If it’s wider than it is tall then it’s likely a horizontal mount furnace. Next, the system will tell you whether you’re likely covered by the settlement or not. Either way you can still submit a claim. Download or view the claim form and print it out. Keep in mind that these furnaces have been deemed QUITE dangerous. If you have one it could leak carbon monoxide or cause a fire. If there’s ANY chance you own one of these furnaces you’ll want to submit a claim. If you’ve already replaced the furnace, but still have the serial number, instruction manual, an invoice showing your replaced furnace or an invoice showing the recommendation to replace the old furnace because of “burner, heat exchanger, or expansion joint damage” submit that claim. You can get up to $300 back! See the TCA Staff tidbit for some more details. Fill out your information, attach any required documentation, sign it, date it and mail it in. It’s very important that you sign the form. Your claim will likely be automatically denied if you fail to sign or date it. Any questions? Class Action Lawsuit Settlement Amount(s): $51,800,000 minus $16,400,000 in attorney fees minus $12,500 in the lead plaintiff rewards minus $1,500,000 in Notification Expenses minus $11,000,000 in inspection fees (discounted or otherwise) minus $1 million to pay some or all of the cost to repair property damage caused by a covered furnace minus $11 million to provide cash payments to Settlement Class members who replaced qualifying Furnaces prior to the settlement and up to $100 million or more in discount/rebates from one or more non-party commercial providers, to reduce the effective cost to replace a covered furnace. Anything left over will be going to a charitable organization, to be named at a later date.

TCA Staff Tidbit: How about this one? Not super exciting, but it’s been in litigation since 1999 (roughly.) This one will help homeowners out there who incurred damage to their homes by the listed furnace (both the damage and part of the replacement cost may be covered) and even those who still have one. If you DO have one, make sure to fill out your claim and get it checked out. These are DANGEROUS! It’s also nice that you’ll get a discount for a brand new furnace. No, you won’t get one for free, but, you have used it for this long, so a significant discount should still come in handy. They’re giving away $300 to those who already replaced their heater so it’s entirely likely that you can expect a nice big discount off your new (and likely much needed) furnace. The courts have made it clear that they’re really pushing the defendants to heavily publicize this settlement. They are looking after all of us and want to make sure that we don’t have these dangerous furnaces in our homes. Don’t put your family at risk. The brands included in this settlement include the top names in the industry. You might have one in your home and it could be a ticking time bomb until a seal or burner fails. If you’re lucky you’ll just have a dead furnace and some minor burn/smoke damage in your home. If you’re unlucky your family could pay the ultimate price. Don’t wait, check if you’re included and make your claim now!

 

One more interesting note regarding this settlement, specifically regarding the Settlement Administrator, Epiq Systems, Inc. In the short form notice they included an option to text CLASS to 30364 for more information. Kudos to them for being one of the first to allow Text Messaging for more info. It just sends you a reply directing you to the Settlement Administrator website, but, it’s a step in the right direction. When will we have the first settlement which will allow you to submit your claim by sending a text message? I’ll bet it will happen. Probably not for awhile yet, and likely it will require that the claimant can be verified by the phone number used to send/receive the text message (Unsolicited Text Message or Early Termination Fee Settlement?) but I think we’ll see it happen in the future. Why not? If the claim is regarding a wireless number that can be verified by sending the text message it’s just about as good (or better) than an electronic signature used for online claim forms. We’ll keep watching and you’ll see it here at Top Class Actions!
