Uber agreed to a $290 million settlement to resolve a New York investigation into claims it unlawfully deducted sales tax and Black Car Fund fees from driver earnings.
The Uber driver settlement benefits individuals who used the Uber driver app to provide rides in New York between Nov. 10, 2014, and May 22, 2017, and had deductions for New York sales tax and Black Car Fund fees taken from their earnings.
According to the New York Attorney General’s Office, Uber violated state laws by improperly withholding pay from drivers. Uber driver fees allegedly caused workers to receive less in wages than they were owed under New York law.
Uber is a ride-sharing company that allows drivers to use their own vehicles to give rides to customers who request them through a mobile app.
Uber has not admitted any wrongdoing but agreed to pay $290 million to resolve the claims. The AG’s office reached a similar settlement with Lyft over these allegations in 2023.
Under the terms of the Uber driver settlement, drivers may be owed money based on the amount of pay withheld for fees and taxes. Payments will be made on a rolling basis and will vary depending on the information provided to the Office of the Attorney General.
All payments from the settlement will be considered taxable income. Participating drivers will receive a IRS 1099 tax form related to this settlement award.
Payments may be subject to applicable judgements or child-support enforcement orders. If so, a New York agency will inform eligible drivers of any intent to apply their payments under these orders.
The deadline to file a claim with the settlement is Jan. 31, 2025.
