Case Name
James C. Fogelstrom v. Lamps Plus Inc., Case No. 37-2008-00087512-CU-BT-CTL, in the Superior Court of California, County of San Diego.
Case Summary
On July 11, 2008, James C. Fogelstrom filed the class action lawsuit against Lamps Plus, alleging that the company asked for his ZIP code during a credit card transaction in violation of California law. Specifically, Fogelstrom alleged violations of the Song-Beverly Act, Unfair Competition Law and invasion of privacy. By filing the class action lawsuit, he sought to represent a class of California Lamps Plus customers who were requested or required to provide their ZIP codes during credit card transactions at a Lamps Plus store.
Lamps plus denies the allegations and maintains that its practices did not violate the law. However, the retailer has agreed to settle the ZIP code collection lawsuit to avoid the risk and uncertainty of ongoing litigation.
