Tincup

A $425,000 class action settlement was reached with the makers of Tincup Whiskey to resolve allegations that the whiskey was deceptively marketed as being made in Colorado when it is actually made in Indiana. If you purchased Tincup Whiskey, you may benefit from this class action settlement.

Plaintiffs Mario Aliano, Due Fratelli, Inc., and Derek Hetland hit Proximo Spirits with a class action lawsuit in 2014, alleging that the whiskey maker made deceptive claims on its labels about where its whiskey is made, specifically that its whiskey is made in Colorado.

This Tincup Whiskey class action settlement is for anyone in the United States who purchased Tincup Whiskey from July 1, 2013 through Sept. 16, 2015.

Class Members will receive $4.50 per bottle of Tincup Whiskey, if they have a proof of purchase, and $2.25 per bottle, if they don’t have a proof of purchase. Class Members may claim purchasing up to six bottles maximum.

Those who purchased Tincup at a restaurant or bar may receive $0.75 per each glass of whiskey purchased. Although Class Members may only claim up to five such purchases.

In addition to the monetary relief, Proximo has also agreed to update the label on Tincup Whiskey to include the fact that the whiskey is made in Indiana. Proximo has also agreed to update the information on its website and other marketing materials.

Proximo Spirits does not admit to any wrongdoing but has agreed to this class action settlement to avoid the cost and risk of going to trial. U.S. District Judge Kathleen Pantle granted preliminary approval to the Tincup class action settlement on Sept. 16, 2015.

UPDATE: On Feb. 10, 2016, according to the settlement website Class Members who filed a claim for the Tincup Whiskey class action lawsuit should expect a check on or before April 21, 2016.

UPDATE 2: On Apr. 23, 2016, Top Class Actions readers started receiving Tincup Whiskey settlement checks worth as much as $17.25.

Who’s Eligible

This Tincup Whiskey class action settlement is for anyone in the United States who purchased Tincup Whiskey from July 1, 2013 through Sept. 16, 2015.

Potential Award

Class Members will receive the following:

  • $4.50 per bottle of Tincup Whiskey with proof of purchase for up to six bottles
  • $2.25 per bottle of Tincup Whiskey without proof of purchase for up to six bottles
  • $0.75 per each class of whiskey purchased at a restaurant or bar for up to five glasses.

The maximum amount a Class Member may receive is $27.

Proof of Purchase

No proof of purchase is necessary, but Class Members who have a proof of purchase will receive more per bottle purchased.
