Insurance companies may deem a total loss of vehicle after a car wreck - pemco insurance

PEMCO Insurance Co. and PEMCO Mutual Insurance Co. have agreed to a $14.1 million settlement that will benefit auto policyholders who may have had a total loss underpaid.

The Class is made up of anyone who is a PEMCO insured under an auto policy issued in Washington state who was paid by PEMCO for the total loss of their own vehicle(s) under one of PEMCO’s first party coverages (Comprehensive, Collision, and Underinsured Motorist), for a loss occurring between May 17, 2012, and April 30, 2020, and PEMCO used an estimate that contained a “typical negotiation” deduction as part of the process in valuing their vehicle. 

PEMCO, based in Seattle, provides home, vehicle, rental, boat, umbrella, and other insurance for residents of Washington and Oregon, according to its website. 

A class action lawsuit had alleged PEMCO Insurance, in settling total losses, improperly applied deductions for “typical negotiation,” which resulted in underpayment of those claims to those who were insured. This allegedly breached PEMCO’s insurance contract and violated Washington law.

The amount of each Class Member’s payment will depend on the total loss value PEMCO paid in which the estimate had a “typical negotiation” deduction applied.

Class Members’ payments will be an amount not paid to them previously, up to the amount of the “typical negotiation” deduction, minus a percentage awarded by the Court for attorneys’ fees and costs, as well as any successful challenge amounts.

Under the settlement agreement, PEMCO Insurance retains the right to challenge any submitted claim form; not everyone submitting a valid form will be eligible to receive a payment.

PEMCO denies all allegations of wrongdoing.

A final hearing in the PEMCO insurance total loss class action settlement is scheduled for May 7, 2021.

Anyone who would like to be excluded from or object to the settlement must do so by April 23, 2021.

The deadline to submit a claim form is June 17, 2021.

Who’s Eligible

    glad to see a settlement against Pemco; had a homeowners claim years ago that they diligently worked to avoid paying; I cancelled them and moved. on. IMO, cheap, shady insurance company
