TikTok data privacy settlement payments in the mail

Top Class Actions readers have received payments in the mail from a $92 million class action settlement resolving claims that the social media app collected user information without consent.

The settlement benefits individuals who used the TikTok app before Oct. 1, 2021, including a subclass of Illinois users.

According to the class action lawsuit, TikTok gathered and stored users’ personal information without getting consent or providing notices. Plaintiffs in the case claim TikTok’s actions violated state and federal privacy laws.

TikTok agreed to resolve these claims with a $92 million settlement. 

Under the terms of the settlement, class members were able to receive an equal share of the net settlement fund. Members of the Illinois subclass could receive up to six times the amount received by non-Illinois residents. Our readers received payments ranging from $27.84 to $167.04.

In order to receive a settlement payment, class members had to submit a valid claim form by March 1, 2022.

Optical disk drive class action rebates — round 2

A second round of checks has been mailed in a $180 million settlement resolving claims that optical disk drive manufacturers conspired to raise the price of their products.

The settlement benefits consumers who purchased optical disk drive settlements from 23 states and the District of Columbia between April 2003 and December 2008.

The antitrust class action lawsuit accuses companies such as Panasonic, Toshiba and Samsung of conspiring together to artificially raise and fix the price of optical disk drives. Plaintiffs in the case note the U.S. Department of Justice launched an investigation into the alleged scheme in 2009. 

Sony, Hitachi, Panasonic, NEC, Pioneer and TEAC agreed to pay a total of $180 million to resolve these allegations. 

The first round of payments was distributed earlier in 2022, and a second round of checks is now being sent out to eligible consumers.

The deadline to submit a claim with the settlement was June 28, 2019.

Readers have received checks from a Doctor’s Best class action settlement resolving claims surrounding the brand’s glucosamine supplements.

The settlement benefits consumers who purchased certain Doctor’s Best glucosamine supplements between July 22, 2016, and Feb. 28, 2022.

According to the supplement class action lawsuit, Doctor’s Best glucosamine supplements do not contain glucosamine sulfate. Instead, the supplements allegedly contain less effective ingredients such as glucosamine hydrochloride and potassium sulfate. Consumers say they wouldn’t have paid as much for the supplements if they had known the truth about the product ingredients.

Doctor’s Best agreed to a class action settlement to resolve these claims. 

The settlement allowed consumers to collect a 60% refund with proof of purchase or $5 per product without proof of purchase. Several readers received payments of $25.

The settlement claim deadline was June 14, 2022.

The Doctor’s Best glucosamine class action lawsuit is Sharae Casey v. Doctor’s Best Inc., Case No. 8:20-cv-01325-JLS-JDE, in the U.S. District Court for the Central District of California.

UKG biometric privacy class action rebates

Top Class Actions readers have received payments from a $3.3 million UKG class action settlement that resolved biometric privacy allegations.

The settlement benefits individuals who scanned their fingerprints or had their pictures taken in Illinois using an UltiPro TimeBase time clock, TouchBase time clock or NOVAtime time clock between March 3, 2015, and Dec. 29, 2021.

According to the Illinois Biometric Information Privacy Act (BIPA) class action lawsuit, UKG’s time clock systems unlawfully collected and stored worker biometrics including fingerprints and facial geometry scans. UKG allegedly failed to comply with state regulations that require businesses to get consent and provide specific disclosures before collecting biometrics.

UKG agreed to pay $3.3 million to resolve these claims. Class members could receive an equal share of the settlement fund, estimated to be between $200 and $400. Actual reported payments were $214.

The claim deadline for the settlement was May 6, 2022.

The UKG BIPA class action lawsuit is Jackson, et al. v. UKG Inc., f/k/a The Ultimate Software Group Inc., Case No. 2020L31 in the Circuit Court of McLean County, Illinois.

Herff Jones data breach settlement checks

Readers report payments from a $4.35 million class action settlement with Herff Jones resolving claims surrounding a 2021 data breach.

The settlement benefits individuals whose payment card information was compromised in a 2021 Herff Jones data breach. Consumers may have been notified of the breach between May 12 and June 18, 2021.

Consumers say they were not informed of a 2021 data breach before they started finding fraudulent charges on their payment card information. According to the class action lawsuit, Herff Jones confirmed it had been the subject of a data breach only after hackers spent hundreds on consumer cards.

Herff Jones agreed to resolve these claims with a $4.35 million class action settlement. 

The settlement allowed consumers to claim up to $5,000 for out-of-pocket expenses, $200 for lost time and/or a flat payment of $75. Several readers report receiving virtual gift card valued at around $32.

The claim deadline for this settlement was May 12, 2022.

Payments are in the mail from a $7 million false advertising settlement over Nautilus, Bowflex and Schwinn treadmills.

The settlement benefits consumers who purchased various Bowflex, Nautilus or Schwinn treadmills between July 7, 2016, and Nov. 16, 2021.

Plaintiffs in the false advertising class action lawsuit accuse Nautilus of inflating horsepower ratings when marketing its treadmill products. Consumers say they wouldn’t have paid as much for the treadmills if they knew the truth about the products’ horsepower ratings.

Nautilus agreed to pay $7 million to resolve these claims. Consumers could receive an equal share of the settlement fund and a free year of subscription to Nautilus’ workout app, JRNY.

In order to receive benefits, class members had to submit a valid claim form by May 2, 2022.

The Nautilus treadmill class action lawsuit is Robert Walker, et al. v. Nautilus Inc., Case No. 2:20-cv-03414, in the U.S. District Court for the Southern District of Ohio, Eastern Division.
