The father of a man who was killed in a shooting at Pat’s King of Steaks is suing the Philadelphia cheesesteak shop, alleging it was negligent in its duty to keep patrons safe.

Plaintiff David Padro Gonzalez filed the wrongful death lawsuit against Pat’s King of Steaks LP on July 20 in the Philadelphia Court of Common Pleas.

According to the lawsuit, the restaurant had a history of violent altercations on its premises, including another shooting and a stabbing, yet it did nothing to prevent the death of Padro Gonzalez’s son in 2021. 

“Despite the known history of violent crimes and unruly patrons on their property during late night and early morning hours, the Pat’s Steaks defendants refused to hire security personnel to act as a deterrent and to intervene to stop unruly behavior from escalating into violence,” the lawsuit alleges.

The lawsuit adds that, less than two months after the shooting, a 28-year-old man was punched and beaten to death on the Pat’s Steaks property after an argument over a soccer game played a few hours earlier. 

“The victim’s 64-year-old father and another patron were also injured in the fight.”

Nothing done since to remedy the security issues, lawsuit alleges

David Padro Jr. was killed at Pat’s Steaks the night of July 22, 2021. 

According to the complaint, Padro got into an argument with a woman, Jamie Frick, over a traffic collision, when Frick’s boyfriend exited a vehicle with a 9 mm handgun.

Burkert hit Padro on the head with a napkin dispenser and shot him, the complaint said. Padro collapsed and was taken to Thomas Jefferson University Hospital, where he was pronounced dead at 1:23 a.m.

The lawsuit also alleges Pat’s surveillance system acted simply as a deterrent to keep employees from stealing cash, rather than protecting the restaurant’s patrons. Nothing had been done to remedy the security situation since the incidents, the lawsuit states.

The plaintiff is seeking damages, medical expenses, funeral expenses, expenses of administration and more.

Meanwhile, a woman whose femur was shattered when she was shot outside a “boisterous” party at an Airbnb rental has sued the company and the property owner for her injuries, saying the party could have been prevented.
