Walgreens Menthol Cigarettes Class Action Lawsuit Overview: 

  • Who: Fernanda Price filed a class action lawsuit against Walgreen Co. 
  • Why: Price claims Walgreens misrepresents menthol cigarettes it sells as being the same as traditional non-menthol cigarettes. 
  • Where: The class action lawsuit was filed in Florida federal court. 

Walgreens misrepresents menthol cigarettes it sells as being the same as traditional non-menthol cigarettes, a new class action lawsuit alleges. 

Plaintiff Fernanda Price claims Walgreens fails to provide a warning that menthol cigarettes “pose additional health risks far beyond those seen with non-menthol cigarettes.” 

“Defendant represents the Products as mere ordinary cigarettes when, in fact, they are not because menthol cigarettes are far more dangerous and addictive than any other type of cigarette available to consumers,” the Walgreens class action states. 

Studies have shown that menthol “increases the appeal of tobacco and facilitates addiction,” the Walgreens class action alleges.

Price claims tobacco products with menthol can also be “more addictive” and “harder to quit” due to menthol “enhancing” the effects of nicotine. 

“Despite the wealth of scientific research elucidating the inordinate hazards of menthol cigarettes, Defendant provides no warning or disclaimer of the Products’ disproportionately toxic effects,” the Walgreens class action states.

Walgreens Class Action Alleges Retailer Falsely Advertises Menthol Cigarettes

Price argues that, due to Walgreens failure to provide a warning, consumers like herself have purchased a product which is “unreasonably harmful and addictive.” 

Further, Price claims Walgreens falsely advertises and is deceptive in marketing the menthol cigarettes it sells by making “false representations” of the product’s “true nature.” 

“Plaintiff and consumers expected to purchase conventional cigarettes only to learn that they were in fact purchasing a product far more addictive and harmful than any of the other cigarettes available on the market,” the Walgreens class action states. 

Price claims Walgreens is guilty of negligent representation, breach of implied warranty of fitness for purchase and breach of implied warranty of merchantability and in violation of Florida’s Deceptive and Unfair Trade Practices Act

Price wants to represent a nationwide class of consumers who have purchased menthol cigarettes from Walgreens within the past four years. 

Plaintiff is demanding a jury trial and requesting injunctive relief along with actual damages for herself and all class members. 

Earlier this month, the federal government and tobacco companies came to an agreement on how stores should display point-of-sale warnings in regard to the adverse health effects of tobacco products

    I’ve been buying menthol cigarettes from Walgreens and I still buy kool blue menthol cigarettes I’m addicted to the menthol I’ve been smoking them over 10 years I just want to know what’s going on with the lawsuit or if anybody heard anything about the lawsuit

    Every smoker knows that menthol cigarettes are worse for you than normal cigs. And I know for sure that every smoker who smokes on a daily bases knows the difference between menothol and non menthol cigs. You are trying to earn easy money, all of you and it is a shame that there is people out there like you that take advantage of the system to fill your own pockets and take money and time away from the courts that could be used to put away really bad people. Remember this WHAT WOULD JESUS DO? I dont think he would do this to other people do you? And i cant believe you found a lawyer to represent you, i am having a horrible time finding a lawyer for medical malpractice in which i was pass from dr to dr and now i have permenant nerve damage and numbness from my knee to my foot. It just sickens me. This is a dumb lawsuit.
