Update:

  • Survivors of the shooting at Robb Elementary School in Uvalde, Texas, earlier this year officially filed a $2.7 billion class action lawsuit against multiple Texas law enforcement agencies and persons. 
  • Survivors named the city of Uvalde, the Uvalde Consolidated Independent School District, the school district’s police department, the Uvalde Police Department and the Texas Department of Public Safety. 
  • Certain individuals who are current or former members of the agencies are also included as defendants in the class action lawsuit. 
  • Survivors, including parents, teachers and staff members who were at the school on the day of the shooting, argue they sustained emotional and psychological damages as a result of the responding law enforcement officers’ inaction during the event. 
  • Officers reportedly waited 77 minutes after a shooter entered an adjoining classroom at the elementary school before finally killing the 18-year-old gunman. 

Uvalde class action lawsuit overview: 

  • Who: A class action lawsuit is in the process of being filed against a number of law enforcement agencies and officials in Uvalde, Texas, as well as gun manufacturer Daniel Defense and gun shop Oasis Outback. 
  • Why: The class action lawsuit is being filed on behalf of the victims, survivors and families affected by the Robb Elementary mass shooting in Uvalde on May 24. 
  • Where: The class action lawsuit is being drafted in Texas.

A class action lawsuit is in the process of being filed on behalf of victims and survivors of the Uvalde school shooting against the manufacturer of the gun used in the massacre and against several law enforcement agencies. 

The complaint, which is headed by civil rights attorney Charles Bonner, asks for $27 billion in compensation for victims and survivors of the May 24 shooting at Robb Elementary in Uvalde, Texas, which resulted in the death of nineteen children and two adults, KSAT reports. 

A number of law enforcement agencies and officials are named as defendants in the Uvalde class action, including the school police and its chief, Pete Arredondo, along with city police and the border patrol, among others. 

Gun manufacturer Daniel Defense, along with Oasis Outback, the store where the gunman purchased the AR-15 style rifle used in the massacre, have also been named as defendants in the Uvalde class action, KSAT reports. 

Uvalde class action defendants to be accused of violating 14th Amendment rights of survivors, victims

The defendants in the Uvalde class action, which is currently still being drafted, are accused of violating the 14th Amendment rights of the survivors, victims and families impacted by the shooting. 

A similar complaint was filed in Michigan last year by two students who were present during a school shooting at Oxford High School that  resulted in the death of four students and injured seven others on Nov. 30, 2021. 

The students, one of whom was shot in the neck during the shooting, filed their complaint against the Oxford Community School District, asking for $100 million each in total compensation.

    The delay in response by all Texas law enforcement should be held accountable. The gun manufacturer wasn’t at fault and if it it is found the dealer met all the Texas rules in selling the gun, he should not be held at fault.
