Auto salvage company Peddle has been hit with a class action lawsuit alleging it had a pattern in which customers were left coming up short for their cars, seeing bounced checks and delivery issues, as well as a lack of proper vehicle ownership transfers that landed one consumer in jail.
Plaintiff Frederick Miller filed the class action against Peddle LLC on Aug. 16 in a Georgia federal court, alleging violations of federal consumer laws.
According to the lawsuit, consumers’ vehicles were not picked up by the assigned tow company on promised dates and consumers often received lower offers than what Peddle offered when their car was picked up.
The consumers also allege they had payment issues, including bounced checks, and that Peddle did not properly transfer the ownership of vehicles from the former owner after picking up consumers’ former vehicles.
Peddle consumer conduct landed plaintiff in jail, he alleges
The plaintiff says he sold his car to Peddle on Dec. 23, 2020, and the company gave him a check. He tried to deposit it twice, but it didn’t go through, he said. On the third try, it went through; however, he says, Peddle reached out to him afterward and asked him not to cash it — but it was too late.
“While driving back from a trip out of town, Plaintiff was pulled over by highway patrol,” the lawsuit states. “After running his license, Plaintiff was informed a warrant for his arrest had been issued for theft by deception.”
The plaintiff says he was kept in jail overnight and eventually bonded out. He was unable to contact Peddle afterwards and the case was later dropped.
Meanwhile, on Feb. 24, 2023, the Better Business Bureau submitted a written request to Peddle encouraging it to address the pattern of complaints.
The plaintiff seeks to represent anyone in the United States who entered into contracts with Peddle to sell their vehicle and had problems with cashing checks or receiving payment or transfer of vehicle ownership issues, plus a Georgia subclass.
He is suing for breach of contract, negligent misrepresentation, fraudulent concealment and unjust enrichment and seeks certification of the class action, damages, fees, costs and a jury trial.
In 2017, a California woman accused Peddle of sending out unsolicited marketing text messages in violation of federal law.
