Brooklyn Tenants Score Victory Against Landlord in Rent Overcharging Case - hhdc

Certain current and former residents of properties controlled, owned, or managed by Hispanic Housing Development Corp. (HHDC) may be eligible to benefit from a $1.5 million class action settlement agreement.

The settlement Class consists of three Subclasses.

Subclass A consists of tenants at Properties A who entered into a new rental agreement or lease renewal between May 1, 2014, and Jan. 16, 2020, provided a security deposit held for more than six months and were not paid interest on the deposit annually, within 30 days after the end of each 12-month rental period, at least once.

Subclass B is made up of tenants at Properties B who entered into a new rental agreement on or after June 1, 2015, through Feb. 16, 2021, provided a security deposit, and were not provided with a disclosure in their lease of the name and address of the financial institution where their security deposit was being held.

Subclass C consists of tenants at Properties C who entered into a new rental agreement or lease renewal on or after June 1, 2015, through Feb. 16, 2021, and, at least once, were not provided both RLTO summary documents at the beginning or at renewal of the lease.

A class action lawsuit had alleged HHDC failed to pay interest on security deposits, failed to disclose in lease agreements at what financial institution the money was being held, and failed to provide the Residential Landlord and Tenant Ordinance (RLTO) summary and security deposit law summary upon lease and renewal.

HHDC manages more than 3,600 residential units and 47,000 square feet of commercial space in the Chicago region, according to the company’s website.

The final payment amount for each Class Member is not known at this time, but is estimated to be between at least $300 to $400.

The final amount to be paid to each Class Member will be determined per tenancy, not per person. If multiple people shared a tenancy, the individual payments will be distributed equally among all known, named adults on the lease or renewal agreement.

Not every Class Member needs to submit a claim form.

Those who received a legal notice addressed specifically to them at an HHDC property with their Subclass designation indicated on the mailing envelope do not need to file a claim form in order to receive a payment.

Former tenants who qualify as Class Members and those who moved away from an HHDC property after Feb. 16, 2021, and those who otherwise qualify but did not receive a legal notice at an HHDC property with their subclass indicated on the envelope must file a claim form in order to receive a payment.

A final approval hearing will be held July 13, 2021.

Consumers may exclude themselves from or object to the settlement until June 3, 2021.

The deadline to submit a claim is also June 3, 2021.

Who’s Eligible

The settlement Class consists of three Subclasses.

Potential Award

About $400

  • The final payment amount for each Class Member is not known at this time, but is estimated to be between at least $300 to $400.
  • The final amount to be paid to each Class Member will be determined per tenancy, not per person. If multiple people shared a tenancy, the individual payments will be distributed equally among all known, named adults on the lease or renewal agreement.
Proof of Tenancy
  • Proof of tenancy IS NOT needed if you received a Subclass designation printed on your mailing envelope.
  • Proof of tenancy IS needed if you did not receive a settlement notice addressed specifically to you with your Subclass designation printed on the mailing envelope. Acceptable documentation could include a copy of your signed lease, recertification documents for HHDC housing, or a receipt for your security deposit. Utility bills or bank statements are not sufficient proof of tenancy for the purposes of proving Class Membership.
