An asbestos mesothelioma lawsuit was recently filed by two plaintiffs claiming that a series of employers and manufacturers created dangerous products or environments that led to the plaintiff’s development of asbestos mesothelioma. Many individuals have developed potentially deadly lung cancer or mesothelioma after being exposed to asbestos.

Plaintiff James E. allegedly developed asbestos mesothelioma after working for or being exposed to products made by companies including Armstrong International Inc, Crane Co., General Electric Company, Pfizer Inc, and more. James claimed these defendants knew, or should have known, that they were putting individuals at risk of developing a potentially deadly disease.

Asbestos Mesothelioma Dangers

Asbestos has been used in countless products for decades. As more individuals began to suffer from asbestos mesothelioma or lung cancer, companies eventually stopped using it in products. It is now a known carcinogen.

However, asbestos can remain undetected in the body for years, even decades before it develops into lung cancer or mesothelioma.

The asbestos mesothelioma lawsuit states, “The Defendants have known or should have known since at least 1929 of medical and scientific data which clearly indicates that the products, asbestos and asbestos-containing products were hazardous to the health and safety” of the plaintiff.

The lawsuit also alleges the defendants hid the dangers of asbestos from the plaintiff through the 1970s, denying James “the knowledge with which to take necessary safety precautions such as periodic x-rays and medical examination, cessation of smoking, and avoidance of further dust exposure.”

Asbestos Mesothelioma Lawsuit

James filed this asbestos mesothelioma lawsuit after developing mesothelioma (cancer in the lining of the lungs). His wife, Nancy E., also joined in the asbestos lawsuit filing for loss of consortium or loss of intimacy with a spouse.

Although asbestos is no longer used, individuals are still developing asbestos mesothelioma or lung cancer decades after initial exposure. Many have chosen to file asbestos lawsuits in order to win compensation for any medical costs or loss of wages caused by the condition.

Claims in this asbestos mesothelioma lawsuit included negligence, inadequate design or formulation, breach of implied warranty, willful and wanton conduct, false representation/fraud, failure to warn, conspiracy and punitive damages, loss of consortium, and  compensatory and punitive damages.
