Mississippi Woman Seeking Damages over Mirena IUD Side Effects

By John Curran

Mirena IUD LawsuitA 22-year-old woman is seeking damages from Bayer Healthcare Pharmaceuticals in a Mirena IUD side effects lawsuit, alleging that the intrauterine device caused her to experience severe pain.

Jazmé Reed had the device placed in 2007 by her gynecologist and for several years had no problems. However, she began experiencing severe pain in March 2012, and her doctor discovered that the device had embedded in the myometrium, or the second layer of the uterus. Due to the painful Mirena IUD side effects, the doctor tried to remove the device while the woman was on pain relievers. The doctor allegedly required two attempts to successfully remove the device.

As a result of the injuries caused by Mirena IUD spontaneous migration side effects, Reed alleges that she does not know if she will be able to have more children. Further, she says she suffered from abdominal pain, bleeding and other problems, some of which continue to exist at the time she filed the Mirena IUD lawsuit.

According to her Mirena IUD lawsuit attorney, Bayer Healthcare Pharmaceuticals “does not warn about spontaneous migration of the IUD, but only states that migration may occur if the uterus is perforated during insertion.” In addition, in spite of the number of adverse event reports, the company reportedly did not exercise its duty to request a label change from the U.S. Food & Drug Administration (FDA).

Bayer was rebuked by both the FDA and the state of Oregon for advertising campaigns in 2009 that included false positive allegations and according to both government entities, failed to properly warn women like Reed of the potential for Mirena IUD spontaneous migration side effects. Reed is seeking damages on counts of negligence, defective design and manufacturing, failure to warn, misrepresentation, strict liability, and failure to test.

The Mirena IUD side effects lawsuit is Jazmé D. Reed v. Bayer Healthcare Pharmaceuticals Inc., Case No. 13-cv-00181, in the U.S. District Court for the Southern District of Mississippi.
