Templeton Rye Whiskey Bottle

Templeton Rye Spirits LLC has agreed to pay $2.5 million to settle a class action lawsuit alleging it engaged in deceptive marketing by failing to adequately disclose that its rye whiskey product was distilled in the State of Indiana. If you purchased Templeton Rye whiskey between Jan. 2, 2006 and July 21, 2015, you may be entitled to a cash payment from the class action settlement.

Plaintiffs Mario Aliano and Due Fratelli filed the class action lawsuit, which alleges Templeton Rye engaged in deceptive marketing and charged premium prices for its Templeton Rye whiskey by stating the product was “small batch” and “made in Iowa” even though it was actually distilled in Indiana.

Templeton Rye denies all allegations of wrongdoing and maintains that its conduct was lawful. However, it has agreed to settle the whiskey labeling class action lawsuit to avoid the expense and risk of litigation.

In addition to providing cash benefits to Class Members who submit timely and valid claims, Templeton Rye has also agreed to modify its labeling and website to remove the phrases “Small Batch” and “Prohibition-Era Recipe.” It will also modify the back panel of the Templeton Rye whiskey label to disclose that the product is distilled in Indiana.

If you wish to exclude yourself from or object to the Templeton Rye class action settlement, you must do so no later than Nov. 3, 2015.

UPDATE: On Feb. 10, 2016, according to the settlement website Class Members who filed a claim for the Templeton Rye settlement will receive a check on or before March 9, 2016.

UPDATE 2: On Mar. 11, 2016, according to reader comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for the Templeton Rye whiskey settlement began receiving checks worth as much as $23.

Who’s Eligible

Class Members of the Templeton Rye whiskey settlement include anyone in the United States who purchased bottles of Templeton Rye whiskey or purchased alcoholic beverages containing Templeton Rye whiskey between Jan. 1, 2006 and July 21, 2015.

Potential Award

Up to $36.

Class Members who submit a Claim Form with proof of purchase will be entitled to a payment of $6 per bottle of Templeton Rye whiskey they purchased, up to a maximum of six bottles per Class Member.

Class Members who do not provide proof of purchase when they file a claim will be eligible for a payment of $3 per bottle of Templeton Rye they purchased, up to a maximum of six bottles per Class Member.

Class Members who submit a claim for alcoholic beverages containing Templeton Rye whiskey they purchased at a bar or restaurant will be eligible to receive a payment of $1 per beverage, subject to a cap of five drinks.

NOTE: Class Members are limited to one Claim Form per household.

Proof of Purchase

N/A. However, Class Members who do not provide proof of purchase will be limited to a payment of $3 for each bottle of Templeton Rye purchased (up to six bottles). Class Members who do provide proof of purchase with their Claim Form will be entitled to a cash payment of $6 per bottle (up to six bottles).

    My check for the Templeton Rye Spirits LLC bounced. Anyone else having this issue? I also got hit with a $12 fee from my banking institution for the returned check.
