Peg Perego USA Inc. has agreed to settle a class action lawsuit alleging it improperly labeled and sold its children’s riding vehicles as being “Made in USA.” If you purchased a Peg Perego children’s riding vehicle that had a “Made in USA” label, you may be eligible for benefits from the class action settlement.
Lead plaintiff Eric Hofmann initially filed the class action lawsuit against Peg Perego in August 2014, alleging the baby products manufacturer violated California law by advertising its various children’s riding vehicle products as “Made in the USA” or “Made in USA” even though they did not meet the standards to include such a label. The class action lawsuit alleged Peg Perego violated California business law and the California Consumers Legal Remedies Act.
In March 2015, Hofmann filed an amended complaint that includes a Class of consumers who purchased the allegedly mislabeled products anywhere in the United States.
Peg Perego denies any liability but agreed to settle the class action lawsuit to avoid the burden and expense of continued litigation. The Made in USA settlement was preliminarily approved on June 19, 2015.
Who’s Eligible
Class Members of the Peg Perego settlement include anyone who, between Aug. 11, 2010 and Dec. 31, 2014, purchased a Peg Perego children’s riding vehicle in the United States that bore a “Made in USA” label.
Potential Award
Class Members who submit timely and valid Claim Forms will be eligible to receive a free children’s safety vest (valued at $20) for every qualifying product purchased.
UPDATE 5/12/16: The settlement website has been updated with the following: “An appeal was taken in this matter but has been dismissed. Safety vests are expected to ship Summer 2016 to approved claimants.” Top Class Actions will continue to provide updates as we learn more.
