Bank of the West TCPA Class Action Settlement

A federal judge has preliminarily approved a $3.35 million class action lawsuit settlement with Bank of the West over claims the bank illegally called consumers on their cell phones in violation of the Telephone Consumer Protection Act (TCPA).

If you received a cell phone call from Bank of the West or an entity calling on its behalf since 2008, you may be eligible to claim between $25 and $50 from the Bank of the West TCPA class action settlement. In addition, Settlement Class Members may submit a revocation request which will prevent Bank of the West from placing certain types of cell phone calls.

Plaintiffs in the class action lawsuit (Bayat v. Bank of the West) accuse the bank of violating the TCPA by using an automatic telephone dialing system or prerecorded/artificial voice to call consumers on their cell phones. TCPA regulations strictly prohibit this.

Bank of the West denies any wrongdoing but agreed on June 6 to pay a $3,354,745.98 class action settlement to resolve the litigation and avoid the expense and uncertainty of going to trial.

U.S. District Judge Edward M. Chen preliminarily approved the Bank of the West TCPA settlement on July 22. A Final Approval Hearing will be held Jan. 7, 2015.

Who’s Eligible

Class Members of the Bank of the West TCPA settlement include anyone within the United States who received a non-emergency call on their cell phone from Bank of the West, or any other entity on its behalf, on or after Nov. 2, 2008 through July 22, 2014.

Potential Award

$25 to $50 (estimated). The actual award may be more or less, depending on how many valid Claim Forms are filed. Claims will be paid if the Court approves the settlement at the Final Fairness Hearing and after any appeals, if filed, are resolved.
