Michael Kors Outlet Pricing Class Action Lawsuit Settlement

Michael Kors has agreed to settle a price label class action lawsuit that alleged the fashion retailer deceptively marketed merchandise at Michael Kors Outlet stores to consumers by placing a “Manufacturer’s Suggested Retail Price” (MSRP) on sales tags suggesting that the product was discounted.

The Michael Kors class action lawsuit filed by lead plaintiff Tressa Gattinella claimed that the merchandise was made exclusively for sale in Michael Kors Outlet stores, but consumers are led to believe the items were previously offered for sale at a Michael Kors retail store.

Retailer Michael Kors maintains that its marketing and labeling is not deceptive or misleading and is entirely proper and permitted by law. However, the company has agreed to a $4.8 million settlement in order to avoid the expense of further litigation.

As part of the Michael Kors settlement, the fashion retailer has also agreed to change the way price tags are labeled at their outlet stores. The company claims that within six months, all “MSRP” labels will be replaced with the word “value” on price tags.

The retailer agreed to also place signs in all Michael Kors Outlet Stores to further explain to customers that the meaning of the word “value” on a sales tag should not be used as a reference price for a product sold at a Michael Kors retail store.

 Michael Kors settlement began receiving checks worth as much as $170.04.

Who’s Eligible

Class Members of the Michael Kors class action settlement include individuals who purchased at least one item at a Michael Kors Outlet Store containing a price tag that showed both an “MRSP” and an “Our Price” between July 25, 2010 and July 25, 2014.

Potential Award

Varies.

The Michael Kors settlement fund will include $4,875,000 and all Class Members who submit a valid claim form will receive a percentage of that money based on a point system. 

• Class Members who submit a claim form but do not submit a valid receipt showing a purchase of Michael Kors Outlet merchandise will receive one point.
• Class Members who submit receipts showing purchases made at a Michael Kors Outlet Store totaling less than $200 will receive two points.
• Class Members who submit receipts showing purchases made at a Michael Kors Outlet Store that total $200 to $499 will receive three points.
• Class Members who submit receipts showing a total of $500 to $999 will receive four points.
• Class Members showing receipts that they purchased a total of $1,000 or more will receive five points.

The point system will determine how much of the settlement fund each Class Member will receive.

Proof of Purchase

The Michael Kors class action settlement does not require a proof of purchase. However, Class Members who submit receipts showing their proof of purchase at a Michael Kors Outlet Store will be awarded more points and therefore be eligible for more benefits.
