Lenovo LawsuitLenovo Inc. has reached a settlement that will resolve a class action lawsuit over an alleged laptop defect, according to court documents filed last week in California federal court.

On Friday, plaintiff Garrett Kacsuta filed a motion seeking preliminary approval of the Lenovo class action settlement, which would resolve allegations Lenovo sold certain “U Series” Ultrabook computers that contained a design defect that affected their Wi-Fi capabilities. The class action lawsuit alleged the Lenovo computers did not consistently connect to Wi-Fi networks and that the problem remained even after users returned them to Lenovo for repairs.

Kacsuta initially filed the Lenovo Ultrabook class action lawsuit in California federal court in February 2013. Michael Wheeler filed a similar class action lawsuit in the Superior Court for the District of Columbia. The parties subsequently agreed to engage in mediation sessions in attempt to reach an adequate resolution. According to the class action settlement, Kacsuta will file an amended class action lawsuit to add Wheeler as a named plaintiff.

“Based upon extensive analysis of the facts and the law applicable to Plaintiffs’ claims, and taking into account the extensive burdens and expense of litigation, … Class Counsel have concluded that the settlement provides substantial benefits to the Settlement Class and is fair, reasonable, adequate and in the best interests of Plaintiffs and the Settlement Class,” the Lenovo class action settlement documents say.

The plaintiffs seek certification of a Class of consumers who purchased a Lenovo Ideapad model U310 or U410 Ultrabook computer in the United States. Under the terms of the proposed Lenovo class action settlement, Class Members who submit valid Claim Forms will be able to choose from four settlement benefits:

  • Repair to the wireless capability of the affected computer;
  • A cash refund of $100;
  • A $250 credit certificate toward the purchase of any product listed for sale on the Lenovo website;
  • In addition to electing either of the first three options, Class Members may also elect to receive a 100 percent reimbursement for actual out-of pocket expenses paid for the repair of the wireless capacity of the affected Lenovo computer.

 

According to the class action settlement, approximately 83,000 allegedly defective Lenovo computers were sold.
