An NBA team that has been embroiled in controversy over racist comments made by its owner is awaiting a judge’s approval to close out a TCPA class action lawsuit that accused the Los Angeles Clippers of illegally sending unsolicited text messages.
The Los Angeles Clippers text spam class action lawsuit alleges that the lead plaintiff and other fans of the club received an unsolicited text message from an automated telephone dialing system in violation of the federal Telephone Consumer Protection Act (TCPA). The class action settlement would cover all people who, without prior consent, received a text between Feb. 6, 2009 and the date of the judge’s order. There are two possible settlement options for Class Members who received at least one unsolicited text message:
1) Two free tickets to a home game on Oct. 8, 17, 22, or 24, 2014. The two tickets would normally cost between $15 and $25 for a total value of $30-$50.
2) One free ticket to one of those games plus a $20 voucher that could be used either at the stadium’s store or online at www.clipperstore.com.
The Los Angeles Clippers text class action lawsuit notes that depending on how many of the 37,809 potential Class Members register for either option, the block of 8,000 tickets may be fully accounted for by the time of the claim submission, with a deadline of July 30. An additional 6,000 tickets would be made available for October 2015 home games and, if that doesn’t cover all the plaintffs, the alleged text spam recipients would receive a voucher to the stadium store for $40.
The total amount available would be $5,283,920 according to the motion to approve the LA Clippers text class action settlement. While the per plaintiff payout would be less than the $500 award provided for by the Telephone Consumer Protection Act, it is substantially higher than what is normally achieved through settlement talks in unsolicited text message lawsuits.
