Toyota data sharing class action overview:

  • Who: A Toyota vehicle owner has filed a class action lawsuit against Toyota Motor North America Inc., Progressive Casualty Insurance Co. and Connected Analytic Services.
  • Why: The plaintiff claims Toyota and Connected Analytic Services collected and shared his vehicle data without his consent.

A Toyota vehicle owner has filed a class action lawsuit against Toyota Motor North America, Progressive Casualty Insurance Co. and Connected Analytic Services, claiming the companies shared his vehicle data without his consent.

Plaintiff Philip Siefke’s Toyota data privacy class action lawsuit alleges Toyota and Connected Analytic Services collected and shared his vehicle data with Progressive without his consent.

Siefke claims Toyota and Connected Analytic Services collected data from his vehicle, including location, speed, direction, braking and swerving events and image and voice data, then sold it to Progressive and other third parties.

“Toyota, however, never provided Plaintiff with any sort of notice that Toyota would share his Driving Data with third parties,” the Toyota data sharing class action says.

Siefke wants to represent all individuals in the United States who owned or leased a model year 2018 or newer Toyota vehicle equipped with tracking technology.

Class action: Toyota, Progressive, Connected Analytic Services breached data sharing policies

Siefke argues Toyota, Progressive and Connected Analytic Services all claim in their respective data sharing policies that they do not share vehicle data without the owner’s consent.

The plaintiff claims he discovered his data had been shared when he attempted to sign up for a policy with Progressive and opted out of the company’s Snapshot data sharing program, only to be notified that Progressive already had his vehicle data.

Siefke claims the companies are guilty of invasion of privacy, breach of express and implied contract and unjust enrichment, and that Toyota violated the Computer Fraud and Abuse Act and the Federal Wiretap Act.

He demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory and punitive damages for himself and all class members.

Progressive recently agreed to a $3.25 million class action lawsuit settlement to resolve claims that it failed to protect consumers from a data breach that compromised sensitive information, such as Social Security numbers and financial account data.

    This has happened to me too. I have 2019 GMC Acadia Denali bought new 2019. Kept getting b emails from GM & Onstar from trial offer for all the stuff Onstar could do. I continually declined their offers. It spoke of how it lower my insurance cost by letting them observe my driving habits and use. As I saw my premiums going up every six months and when it got to $244/mth Isrzrted seachering for a new carrier. I used one those sights that says you can save $5-600/ yr. I got a couple of quotes but nothing that was worth changing for. But I also got a letter from Liberty Auto Ins stating due to information recieved from LexusNexus they would be unable to give me a quote and I could get a copy of my report since I was declined. In searching for Lexus phone number a site popped up regarding a class- action law suite due to unauthorized receipt of person data from my onstar system. It named GM, onstar and LexusNexus for selling custmer data without authority. I request a printed copy from Lexus twice and once on line but have not been able get one yet. I was able to pull one up from a link they emailed me but it would not print. Our car has automatic breaking and adaptive cause controll. If you don’t have them you won’t understand. They are great but do have a learning curve if you’re unfamiliar with them. W with the auto breaking if you’re rounding a corner and there’s a car in left turn lane at a red light, even though you have a Green light as the radar sees the car straight ahead as you turn, it will SLAM on breaks. If your on a trip with cruise control set if a car pulls in your lane within the separation distance you’ve set for the car in front of you, it will slam on breaks. All of this shows up on your report as abrupt stop. This looks like you are a tailgating.
    It’s time congress passes a law stating if you sell someone info obtained without permission they must pay you 50% of money recieved for selling your info.
