Fighting unfair total loss insurance settlements

Was your total loss insurance claim underpaid by your insurance company? Some insurers may use inaccurate adjustments to lower payouts.
If you feel you were not paid enough for your totaled car, fill out the form on this page to see if you qualify for a car insurance lawsuit.
Experiencing a total loss car accident is stressful enough. Drivers shouldn’t have to worry about whether their car insurance company is paying them fairly.
Unfortunately, some insurers low-ball total loss payouts by using a “projected sold adjustment” in their calculations — factoring in potential buyer discounts rather than the actual market value of the car.
If you believe your totaled vehicle was undervalued, you may be entitled to file a car insurance lawsuit and pursue compensation for an undervalued total loss vehicle.
Do you qualify?
Some major car insurance companies may incorrectly adjust the value of a vehicle to lower total loss payouts.
If your total loss settlement was less than expected and you believe your car insurance company undervalued your claim, you may be eligible to join a car insurance lawsuit. A total loss insurance claim investigation could help you pursue the compensation you deserve.

What is a total loss insurance claim?
In the most basic terms, a total loss occurs when your car is so severely damaged in a traffic collision that repairing it would cost more than the vehicle’s value.
The method for determining a total loss can differ by state and insurer, which can directly affect the payout you receive. Knowing how a total loss is determined can help you spot if your settlement was fair or potentially undervalued.
How do insurance companies calculate total loss?
When calculating a total loss insurance claim, insurers typically rely on an independent appraiser to evaluate the vehicle’s market value. This evaluation considers multiple factors, including mileage, overall condition, and normal wear and tear. Car insurance companies may also compare your car to similar vehicles for sale in your area to determine a fair market value.
In addition to the vehicle’s assessed value, your total loss payout may include other costs such as sales tax, title fees, and registration fees, depending on your state and your insurer’s policies.
How are insurance companies lowering insurance payouts?
Some car insurance companies are reportedly reducing total loss payouts by using questionable adjustments, such as “projected sold adjustments.” This method assumes that if a comparable vehicle were resold, the seller would offer a discount, which lowers the perceived value of your car.
As a result, your total loss settlement could be hundreds of dollars less than the actual market value of your vehicle.
How to join a total loss lawsuit investigation
Insurance companies are supposed to pay the full value of your totaled vehicle, but when they devalue your total loss, it can create financial hardship and stress during an already trying time.
If your total loss insurance claim was lower than expected, you may be eligible to join a total loss car insurance lawsuit investigation. Participating could help you pursue additional compensation and hold the insurer accountable for undervaluing your vehicle.

My boyfriend and I were involved in a hit and run. The other driver was intoxicated blew threw a stop sign hitting us and spinning our car a complete 360° and then facing opposite direction we were heading. We were both injured, his car was determined a loss, his gas powered pedal assist bike that he had built himself was completely smashed and I would like another look into our case.
