A new class action lawsuit alleges TA3 Inc. and Route App Inc. deceptively add junk fees to customers’ orders.

Plaintiff Lauren Wolf-Bond claims the companies add the fees to customers’ orders without their knowledge or consent, despite advertising free or flat-rate shipping.

Wolf-Bond filed the class action lawsuit against TA3 and Route App on March 26 in a California state court, alleging violations of state and federal consumer laws.

TA3 is a swimwear company, and Route App is a delivery tracking service.

According to the class action lawsuit, Route App partners with e-commerce retailers like TA3 to offer “shipping protection” for customers’ orders.

The Ta3 class action lawsuit alleges the fee is a “junk fee” that provides no added value to customers and is deceptively named and described.

TA3 junk fees are ‘deceptive,’ class action lawsuit claims

Wolf-Bond claims she purchased swimwear from TA3’s website and was charged a $3.75 Route shipping protection fee that was automatically added to her cart.

She says she was unaware of the fee and would not have purchased the shipping protection if she had known it was optional.

The class action lawsuit alleges TA3 and Route App’s practices violate California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act as well as the federal guidance on junk fees.

Wolf-Bond seeks to represent a class of all consumers who paid a Route App shipping protection fee or similar fee for a purchase on TA3’s website within the applicable statute of limitations.

She is suing for unjust enrichment and breach of contract and is seeking certification of the TA3 junk fees class action lawsuit, damages, fees, costs and a jury trial.

In related news, a consumer filed a class action lawsuit against True Classic Tees LLC for falsely advertising free shipping on its website while charging a hidden fee.
