Skechers class action lawsuit overview:

A new class action lawsuit claims Skechers USA Inc. sends spam emails with misleading subject lines to its customers.

Plaintiffs Stephen Liss and Boni Melchor argue in their Skechers class action lawsuit that the footwear company’s emails create a false sense of urgency by misleadingly suggesting that consumers have a limited time to take advantage of discounts.

“This false sense of urgency wastes consumers’ time by enticing them to engage with Skechers’ marketing for fear of missing out,” Liss and Melchor say in the Skechers class action.

Liss and Melchor claim the alleged Skechers emails violate Washington’s Commercial Electronic Mail Act, which they argue applies to commercial emails that contain false or misleading information in their subject lines.

The plaintiffs argue Skechers sent out at least 388 marketing emails to thousands of customers and are seeking $1,500 in damages for each email.

Skechers denies the allegations but notes in its removal notice that the potential liability in the case exceeds the minimum amount for a federal court case.

If more than 2,000 class members received $1,500 for just two emails, the company’s total liability could exceed $6 million, the Skechers class action lawsuit says.

Liss and Melchor argue that it doesn’t matter if consumers agreed to receive marketing emails because the law only concerns whether the subject lines are false or misleading.

They provide an example of an April 9 email from Skechers that advertised 20% savings with the subject line “Flash Sale Alert! Don’t Miss Today-Only Savings.” However, Skechers allegedly continued to send emails advertising 20% discounts between April 10 and April 15.

The Skechers class action lawsuit references a recent ruling from the Washington State Supreme Court against Old Navy that found the company violated the same law by sending emails with misleading subject lines.

This lawsuit comes on the heels of another Skeckers class action which alleges the company uses fake reference prices to mislead consumers into thinking they are getting a discount on its products.
