Many people purchase their vitamins and supplements from popular manufacturer Puritan’s Pride. However, a Puritan’s Pride false advertising class action lawsuit was recently filed claiming that the company did not accurately offer discounts like they promised.
According to their website, Puritan’s Pride is a vitamin and dietary supplement manufacturer that has been in business for over 40 years. They are headquartered in Long Island, New York, but they have facilities across the United States.
They make over 1,200 “high quality vitamins, minerals and other nutritional supplements with ingredients sourced from all over the world.”
Recently, however, a Puritan’s Pride false advertising class action lawsuit was filed by two California women claiming they and other customers were the victims of false advertising because the “Buy One Get One Free” offer was always available, thereby making the “free” item not truly free.
Essentially, if the “free” products offer never ceases, then this is false advertising, the plaintiffs in the Puritan’s Pride false advertising class action lawsuit claim. The plaintiffs allege that this promotion has been going on for four years.
Federal law states that companies that use an offer of free products or specially bargained prices must do so “with extreme care to avoid any possibility that consumers will be misled or deceived.” It also says that the word “free” needs to mean actually free and that customer can assume without reservation that he or she is paying nothing for the product. The “free” offer must be based upon a regular price.
According to federal false advertising guidelines, promotions like this cannot be offered to customers for more than six months in a twelve-month period. There should also be a 30-day break in between offers like this.
In this Puritan’s Pride false advertising lawsuit, the plaintiffs bought Garcinia Cambogia, Vitamin D3, Calcium, Zinc, Probiotic Acidophilus, Coconut Oil for Skin & Hair, Grapefruit 100% Pure Essential Oil from Puritan’s Pride.
The two plaintiffs purchase products under a “Buy One Get One Free” offer as well as a “Buy One Get Two Free” offer. Allegedly, Puritan’s Pride gives customers the feeling as if these deals will only be offered for a limited time. The two named plaintiffs believe that these offers are permanent which would violate federal law.
