Did you know that Indiana, Maryland and Washington have laws protecting residents from deceptive marketing — especially false or misleading email subject lines?

Now, consumers who received questionable emails are taking action.

See if you qualify for a class action lawsuit by filling out the form on this page. You could receive up to $500 for each unlawful email you received.

In today’s inboxes, email marketing and promotions are everywhere — but not all marketing messages follow the rules. In fact, some companies are sending emails with false or misleading subject lines that exaggerate discounts, extend sales that have ended, or promise “free gifts” that require a purchase.

While most states have general consumer protection laws, Indiana, Maryland and Washington have specific laws targeting misleading email subject lines. These laws aim to protect consumers from deceptive marketing tactics and offer compensation for violations.

If you live in one of these states and have received emails with deceptive subject lines, you may be entitled to join a class action lawsuit.

Do you qualify?

To be eligible, you must meet all of the following requirements:

  • You live in Washington, Maryland or Indiana
  • You received a “false” or “misleading” marketing email from one of the companies listed below
  • You can provide proof of an email received, such as:
    • A copy of the email, or
    • A screenshot of your inbox after searching for the company name

Fill out the form on this page for more information.

Companies under investigation for false or misleading email offers

Several companies are facing allegations of implementing deceptive or false email subject lines in their email marketing campaigns. This class action lawsuit investigation is currently focused on the following organizations:

  • Ashley Stewart
  • Bloomingdale’s
  • Blue Nile
  • Bombas
  • Charles Tyrwhitt
  • Dressbarn
  • Good American
  • H&M
  • Kendra Scott
  • Kylie Cosmetics
  • L’Occitane
  • Life Is Good
  • L.L.Bean
  • New York & Company
  • Omaha Steaks
  • Overstock
  • Rack Room Shoes/Off Broadway Shoe Warehouse
  • Ulta
  • Urban Outfitters
  • vineyard vines
  • VistaPrint

Examples of misleading email subject lines

Many of the companies at the center of this investigation use similar language in their email marketing. These phrases can make an offer sound better than it really is — and in some cases, may violate state laws. Check your inbox for subject lines such as:

  • Our sale has been “extended”
  • “Sitewide” discounts (with hidden exclusions)
  • “Everything” is on sale (with hidden exclusions)
  • “Free gift” (but requires a purchase)

If you have received emails with subject lines like these and live in Indiana, Maryland, or Washington, you may qualify to join a deceptive email class action lawsuit investigation.

How state laws protect you from deceptive emails

Most states have laws that regulate what businesses can say in advertisements and email marketing. However, Indiana, Maryland and Washington have laws that specifically address email subject lines.

These laws ensure that companies:

  • Do not send unsolicited emails
  • Do not disguise who is sending the email
  • Do not use misleading or deceptive information in the email subject line.

If a company violates these rules, residents in those states may have legal options to recover money for each deceptive marketing email they received.

How to join the misleading email class action

If you have received emails from these companies — or any others — with deceptive or misleading subject lines and you live in Indiana, Maryland or Washington, you may qualify to join this class action lawsuit.

If the companies are found to have violated state law, you could be entitled to up to $500 for each unlawful, deceptive marketing email you received.
