If you purchased a product from JCPenney advertised with a discount, you may have a legal claim. Fill out the form to apply to be a client in the JCPenney fake discount arbitrations.

JCPenney is facing allegations that it is engaging in a massive false discount advertising scheme. Shoppers allege that JCPenney promoted constant sales online and in stores, typically ranging from 25% to 70% off, that were not genuine markdowns. Instead, these so-called “discounts” may have been the regular retail price.

According to complaints, this practice tricked customers into believing they were saving money when they were not. Now, a law firm working with Top Class Actions is investigating, helping JCPenney customers seek recovery for possible overpayments, and pushing the company to change its advertising practices to comply with consumer protection laws.

Do you qualify?

  • Did you buy something in a JCPenney store or on its website that was marked with a discount?
  • Was it advertised as a “limited-time offer” or shown with a “Was” or “Regular” price?

If so, you could qualify for arbitration and potential compensation. Fill out the form to see if you are eligible.

How JCPenney’s discount practices are allegedly deceptive

When it comes to JCPenney discounts, consumers say there are two main deceptive practices:

  1. False percentage-off sales and inflated “regular” prices. Shoppers claim JCPenney runs constant sales — often 25% to 70% off — but the “Reg.” or “Was” prices shown on tags were never real. Instead, the so-called discounted price was actually the normal retail price, not a true markdown.
  2. Fake limited-time promotions. Customers allege JCPenney promotes “FLASH SALES” or “LIMITED TIME SPECIALS” that never end. These offers, they say, create a false sense of urgency when the pricing is actually standard.

At the heart of these complaints is the claim that JCPenney used inflated prices and misleading promotions to exaggerate the value of a JCPenney discount, causing shoppers to believe they were saving money when they may have paid more than they should have.

How arbitration could hold JCPenney accountable

Recovering money you may have overpaid on an allegedly fake JCPenney discount may start with a process called arbitration.

JCPenney’s Terms & Conditions prevent shoppers from joining together in a class action lawsuit. Instead, each customer must bring an individual private arbitration, which is decided by a private organization rather than a court.

To help level the playing field, a law firm working with Top Class Actions is filing many of these arbitrations on behalf of JCPenney customers at once. These cases may lead to restitution for shoppers who overpaid for falsely discounted products. By pursuing arbitration, consumers may have a chance to recover their losses and push JCPenney to adopt fairer advertising practices that comply with consumer protection laws.
