Two former employees of Belk have filed class action lawsuits against the department store company after a data breach resulted in the unauthorized access of personally identifiable information (PII) and protected health information.
Plaintiff Andrew Davis filed a class action lawsuit June 16 and Andrea Larson on June 17 in a North Carolina federal court. They claim Belk failed to properly secure and safeguard personally identifiable information and protected health information.
The data breach occurred between May 7 and May 11, 2025, when unauthorized actors stole certain internal documents belonging to Belk.
Davis and Larson claim Belk failed to implement adequate and reasonable cybersecurity procedures and protocols to protect its customers’ and employees’ private information from a foreseeable and preventable cyberattack.
Belk data breach was foreseeable, lawsuits argue
Davis and Larson both allege Belk was aware of the potential risks and failed to take necessary steps to secure the private information.
Davis claims Belk maintained, used and shared the private information in a reckless manner, leaving it vulnerable to cyberattacks.
As a result of the data breach, plaintiffs and class members have suffered concrete injuries, including invasion of privacy, lost or diminished value of private information, lost time and opportunity costs associated with mitigating the consequences of the data breach, among other damages.
The plaintiffs each assert claims for negligence, negligence per se, breach of implied contract and unjust enrichment. They are seeking to represent a nationwide class of individuals whose private information was compromised in the Belk data breach.
Landmark Properties, a real estate firm, also faces a data breach class action lawsuit for allegedly exposing personal sensitive data of residents and employees.
