Toyota Mirai class action lawsuit overview:ย 

  • Who: A group of consumers filed a class action lawsuit against Toyota Motor Sales USA Inc. and several related entities.ย 
  • Why: Consumers claim Toyota falsely assures customers who purchase its Toyota Mirai hydrogen fuel cell vehicles that hydrogen fuel is easy to find.ย 
  • Where: The class action lawsuit was filed in California federal court.ย 

Toyota falsely assures buyers of its Toyota Mirai hydrogen fuel cell vehicles that hydrogen fuel is easy to find, a new class action lawsuit alleges.ย 

A group of consumers claim hydrogen fuel, despite Toyotaโ€™s alleged assurance to the contrary, is continuing to come โ€œmore and more difficult to obtain,โ€ making the Mirai vehicles โ€œunsafe, unreliable and inoperable.โ€ย 

โ€œWhile Toyota sells the Mirai while assuring consumers that hydrogen refueling is available, seamless, and comparable to refueling with gasoline, that is not the case,โ€ the Toyota Mirai class action says.ย 

The consumers want to represent a California class of consumers who have purchased or leased model year 2021-2024 Toyota Mirai vehicles.ย 

Toyota aware of refueling limitations with Mirai vehicles, class action claims

The consumers argue owners of Toyota Mirai vehicles are either unable to use their vehicle or have to travel long distances to find hydrogen fuel and, in many cases, are ultimately unable to find it at all.ย 

โ€œDespite Toyota being aware of these refueling limitations, throughout the relevant period, Toyota and its salespeople tell customers prior to sale and/or lease of its Mirai vehicles that hydrogen fuel is available and that refueling the Mirai is seamless,โ€ the Toyota Mirai class action says.ย 

The group of consumers claim Toyota is guilty of fraudulent concealment and misrepresentation and unjust enrichment and in violation of the Magnuson Moss Warranty Act and Californiaโ€™sย Song-Beverly Consumer Warranty Act, among other things.ย 

The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of exemplary and punitive damages for themselves and all class members.ย 

Toyota recently issued a recall for more than 145,000 of its Grand Highlander and Lexus TX550 vehicles over concerns their airbags may not work as intended during a crash.ย

    I regrettably purchased a 2022 Mirai under false pretenses of an abundance of fuel/stations as well as MPG in the 400s which in actuality is not even half that number.

    I leased a 2020 Mirai and then Financed a 2023 Mirai Limited. Problems with refueling in both cases, the first car caused me to go well over my lease miles at MY expense and the second car caused me to use the $15K prepaid H2 miles within 8 months due to tripling of fule cost! Now I pay for a nice $60K paperweight that is not driven.
