Toyota hydrogen fueling class action lawsuit overview: 

  • Who: A group of consumers filed a class action lawsuit against Toyota Motor Sales U.S.A. Inc. and First Element Inc. 
  • Why: The consumers claim Toyota pollutes the environment with its hydrogen-fueled Mirai vehicle and holds a monopoly over the hydrogen fueling market. 
  • Where: The class action lawsuit was filed in California federal court. 

Toyota wastes millions of dollars and pollutes the environment with its hydrogen-fueled Mirai vehicle, a new class action lawsuit alleges. 

A group of consumers from California claim Toyota “spins a web of lies” about the Mirai while exerting “unprecedented nefarious control over Californians.” 

“It is undeniable that Toyota is the only real player in the hydrogen fuel car market in the United States,” the Toyota class action says. 

The group argues Toyota does not produce clean hydrogen for its Mirai vehicles and blocks it from entering the market, which is paid for by taxpayers. 

The consumers want to represent a class of California taxpayers from 2011 or since Toyota began receiving hydrogen benefits from the state and a nationwide subclass of consumers who own or ever owned a Toyota Mirai vehicle. 

Toyota Mirai more pollutive than gas-powered vehicles, class action claims

The consumers argue hydrogen-fueled cars like the Toyota Mirai pollute the environment more than gas-powered vehicles and that the automaker argued for years—and to this day—that producing hydrogen fuel from fossil fuels was only a temporary step. 

“Toyota continues with their marketing saying these Mirais are zero emission vehicles and instead engaged in brinkmanship with carbon credit purchases and layers of nefarious control,” the Toyota class action says. 

The consumers claim Toyota is guilty of violating the Sherman Act, the Cartwright Act and the Magnuson Moss Act

The plaintiffs demand a jury trial and request injunctive and declaratory relief and an award of incidental, consequential, treble and punitive damages for themselves and all class members. 

A group of consumers filed a separate class action lawsuit against Toyota in July over claims the automaker falsely assured consumers who bought its Mirai vehicle that it would be easy to find hydrogen fuel.

    I purchased a 2022 Mirai XLE and ran out of fuel card in less than 2 years. I still owed car loans and if I sell this car, I will lose more than $20k out of my pocket. How do I file lawsuit against Toyota who misled me to buy this car?

    My son bought one of these a little over a year ago. He was going to the dealer to buy a used Honda Civic. We called the dealership and it was available. I could not go with him, but I told the dealer he is only going for that one car don’t try and sale him anything else. He’s a kid. He was 19 and they told him the car he went there for was not available. He was desperate and needed a car and thought he was getting the other car. They started selling him the Hydrogen car. They said it goes 60 miles to a gallon well what was comparable to a gallon a Kilo of hydrogen. They said this car would be like owning a hybrid car. He ended up buying they approved him for a loan with 38% interest rate. He know has a credit score of 750 a year ago he just did not have credit. They never lowered interest rates. He was paying a car note of $400 a month and about $500 in gas a month. He said he would wait sometimes 3 hours to get gas. He hated the car and asked the dealer to trade it in only after a week they refused. I called a couple months after trying to tell them that they tricked him and misled him because of his age and they need to make it right. They said he would need to bring in a down payment and he could trade in for way less. He has decided to move to Tennesse but purchase the car for $11000 and put a couple thousand down and he was devastated to learn that he still owes around $10,000 on the car because of warranty and high interest rate loan. He is 21 and a college student and needs to move but can only sale his car for $3,500 so mom (myself) tells him that I would buy the car from him. I normally drive a Chevy Tahoe which is horrible on gas. This car however is the worst car. I want to say I drove truly 70 miles after filling up yesterday for $125.00 and I only have about 90 miles left. I want to say I drove no where near what it is registering for I drove a total of 1 hour in the car and it use a half a tank of gas which would be ($65) This is so unfair and I can’t believe for a year now he has been paying close to $900 to drive this car and really did not pay down the principal at all. This is such a rip off and I could not help him with College before he bought this car he was paying his tuition on his own. The 2nd semester after owning this car he told me he was going to take a semester off. I never thought that it was because he could not afford the gas to drive there let alone to pay for tuition and books. I am so frustrated with Toyota and think this is so wrong. I called an advocate yesterday asking them what they can do and basically nothing. These other people got gas cards and he bought a preowned certified car. Why didn’t he get a gas card? The entire thing is so wrong and I hope they reimburse everyone for their mistakes. That is what needs to happen

    I currently finance a 2019 Toyota Mirai and the mileage gets worse with each hydrogen refill. Definitely been led astray.
