South Carolina abortion ban blocked overview:ย 

  • Who: A South Carolina state judge granted an urgent motion for a temporary injunction that was requested by Planned Parenthood South Atlantic, the Greenville Womenโ€™s Clinic and a pair of individual physicians.ย 
  • Why: The medical providers sought to stop the enforcement of a newly passed state law that criminalizes abortion from as early as six weeks into a pregnancy.ย

A South Carolina state judge granted an urgent motion for a temporary injunction to block the enforcement of a recently passed state law that criminalizes abortion from as early as six weeks into a new pregnancy.ย 

The judge issued the temporary injunction โ€” effective immediately โ€” in response to a lawsuit filed against the state by a division of Planned Parenthood and medical providers arguing the law โ€œviolates the constitutional rights of South Carolinians.โ€

State lawmakers passed the law, called the โ€œFetal Heartbeat and Protection from Abortion Act,โ€ last month, effectively banning abortion upon the first detection of fetal cardiac activity, with some exceptions.ย 

Medical providers, including Planned Parenthood South Atlantic, the Greenville Womenโ€™s Clinic and a pair of individual physicians, argue that the law allows the state to invade an individualsโ€™ constitutional right to privacy, according to the motion.

South Carolina AG argued against emergency request for a temporary injunctionย 

The physicians, along with Planned Parenthood and Greenville Womenโ€™s Clinic โ€” the only operators of abortions in South Carolina โ€” challenged the constitutionality of the act, formally known as Senate Bill 474, in a 63-page complaint last month, Law360 reports.ย 

South Carolina Attorney General Alan Wilson reportedly argued against the medical providersโ€™ emergency request for a temporary restraining order, claiming the complaint did not โ€œestablish the required elements for a temporary injunction.โ€ย 

In approving the motion, however, the judge determined that the act, if permitted to remain in effect, would โ€œleave some South Carolinians without any access to legal abortion,โ€ and โ€œthe status quo should be preserved while the South Carolina Supreme Court resolves this case in as expeditious manner as possible.โ€

Also last month, North Carolina Republicans voted to override Democratic Gov. Roy Cooperโ€™s veto of the stateโ€™s new abortion bill, which bans the majority of abortions after 12 weeks.ย
