FCC net neutrality rules overview:

  • Why: The Obama-era net neutrality rules had previously been reversed by the FCC when Republicans controlled the agency during the Trump administration.

The Federal Communications Commission (FCC) announced that it will be reverting back to net neutrality rules created by the agency during the Obama administration. 

The Obama-era net neutrality rules — which have stirred controversy — had previously been reversed by Republicans after they gained control of the FCC during the Trump administration, reports Law360. 

The decision to return to the Obama-era net neutrality rules was reportedly made by the FCC’s new Democratic majority. The agency now holds a 3-2 Democrat voting majority with the recent swearing in of Commissioner Anna Gomez. 

FCC Chair Jessica Rosenworcel, when announcing the plan Tuesday, said the past decision to reverse the Obama-era net neutrality rules was on the “wrong side of history, the wrong side of the law, and the wrong side of the American public,” reports Law360. 

“Despite overwhelming opposition from the public, the FCC repealed net neutrality. In fact, the FCC’s actions were so extreme the United States Senate voted to restore the agency’s open internet protections,” Rosenworcell said

FCC Chair says reverting to previous net neutrality rules will allow agency to tackle privacy issues, network outages

Net neutrality is the idea that all traffic on the internet should be given equal treatment, and, in regard to the FCC, refers to regulations made to prevent internet service providers from being able to block, slow, or give a paid preference to certain web traffic. 

Rules for net neutrality have previously been achieved, meanwhile, by reclassifying broadband service under the Communications Act from a Title I information service to a Title II telecom service, allowing it to face stricter regulation, reports Law360. 

Republicans, meanwhile, have reportedly shot back at the FCCs plan, after having fought for years under former Chair Ajit Pai to reverse the classification of broadband service as a Title II telecom service. 

Rosenworcel, who acknowledged that the renewed debate over net neutrality “will get messy at times,” said reclassifying broadband service as Title II will enable the agency to tackle problems such as network outages and privacy, among other things, reports Law360. 

In other news involving the FCC, the agency announced in August that it plans to launch a new “Cyber Trust Mark” for smart devices that it says will help better inform consumers about what devices they should trust with their data.

    I prefer the broad fairness under the Obama-era rules to the current Republican pay-to-play rules. I would also like to see a return to the Fairness Doctrine of the Clinton era and earlier.

    I enjoy reading about Class Actions lawsuits. Spectrum is one recently I signed up for because they cheat senior citizens and slow speeds are recorded many times during the day. As an example I have been fighting them for over a year because of their illegal practices.
