Live Nation Ticketmaster class action lawsuit overview: 

  • Who: Abraham Leifer filed a class action lawsuit against Live Nation Entertainment Inc. and Ticketmaster LLC. 
  • Why: Leifer claims Live Nation and Ticketmaster monopolized the live concert and event market when the two companies merged in 2010. 
  • Where: The class action lawsuit was filed in New York federal court. 

A new class action claims that Live Nation and Ticketmaster created an unlawful monopoly in the live concert and event market with their 2010 merger. 

Plaintiff Abraham Leifer’s class action lawsuit claims Live Nation and Ticketmaster monopolized the market for concert promotion for major concert venues and primary and secondary ticketing services for major concert venues. 

Leifer argues Ticketmaster controls the sale of more than 70-80% of all primary ticket sales for major concert venues in the U.S. and Live Nation reinforces their alleged monopoly by forcing the venues it services to use Ticketmaster as their “sole primary ticketing agent.” 

“Thus, on the primary ticket market, Ticketmaster acts as the sole ticket broker between the venue and the end consumer,” the class action says. 

The class action lawsuit was filed the same day the Justice Department filed a lawsuit against Live Nation over its agreement clearing its purchase of Ticketmaster. 

Class action claims Live Nation, Ticketmaster violated Sherman Antitrust Act

Leifer seeks to represent a nationwide class of end-user purchasers who purchased secondary tickets on exchanges from a secondary seller who, in turn, purchased a primary or secondary ticket for an event at a major concert venue in the U.S. from Ticketmaster or one of its affiliated entities owned directly or indirectly by Live Nation since the 2010 merger.

A separate class is proposed for indirect purchasers from 26 U.S. states, Washington, D.C., and Puerto Rico. 

Leifer claims Live Nation and Ticketmaster are violating the Sherman Antitrust Act as well as  antitrust laws from a number of U.S. states. 

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory, actual, compensatory, consequential, treble, punitive and nominal damages for himself and all class members. 

Live Nation previously agreed to a settlement to resolve claims the company artificially inflated ticket prices, in alleged violation of New Jersey consumer protection laws.

    Ticketmaster and live Nation also claim the reason for high-priced tickets are because of scalpers. But it’s their sites that are reselling tickets for two and three times over face value. Now if they really wanted to put a stop to this, they would not let anyone sell tickets more than $35 over face value. They are the ones who who have on their website sertified resale tickets. What is it? Do they pretend to sell out all these tickets and resell them for more profit. I really wouldn’t put it pass these greedy corporations. It’s us as consumers and fans first and foremost that suffer. I would really like to be part of this class action lawsuit I’ve purchased enough tickets this year over face value.

    I want to say customer service is a big issue. The delayed reply and reliance on email correspondence delays customers with real issues. This is a time sensitive product. I was sold a ticket that was already sold to another customer. This also happened to the seat next to mine. Had to settle with the venue by moving to another seat. ticketmaster refused to acknowledge the issue when it was clearly a platform issue. There is no live help so had to call in and wait 40+ mins for a response and was told to submit an email. Email was responded to a couple of days later, but was given no compensation for the error because the concert was over by then. There is no accountability for poor customer service or desire to improve its system. Premium pricing is also an issue. Instead of limiting resellers Ticketmaster inflates the ticket price. Websites have very long, hours long, queues for tickets the day of release. And you place tickets into your “cart” they disappear almost immediately creating a shortage and panic.

    I just received the letter TODAY!!!! I want in!! This is total BS… I put my trust in Ticketmaster and NOW ALL OF MY information IS OUT! What makes this better is that I USED MY DEBIT CARD for all of my transactions with them!!

    I purchased baseball tickets from Ticketmaster a month before the game. Ticketmaster promised to have the tickets delivered the day before the game. This did not happen and they did not proved the tickets the day of the game. After the gane started, we had to purchase a
    SRO seats. Certainly not the experience that we were hoping for. Five days after game and over a month after I purchased the tickets, they have not refunded the money. My two sons and I drive ten hours each way to the game. Not the experience that we were hoping for.
