Texas out-of-state abortion class action lawsuit overview:ย 

  • Who: Abortion rights groups in Texas filed a class action lawsuit against Texas Attorney General Ken Paxton and other local district attorneys.ย 
  • Why: The groups seek an injunction that will allow them to resume helping fund out-of-state abortions for Texas women.ย 
  • Where: The class action lawsuit was filed in Texas federal court.ย 

Abortion rights groups in Texas have filed a class action lawsuit against Texas Attorney General Ken Paxton and other local district attorneys in the hopes it will allow them to resume helping women in Texas receive abortions outside of the state.ย 

Abortion has become more difficult in Texas following the Supreme Courtโ€™s decision to overturn Roe v. Wade in June with three bans on abortion now in place in the state, Spectrum News reports.ย 

Reproductive rights groups, meanwhile, have been dissuaded from being able to raise money to cover costs needed for travel costs and out-of-state abortions over the fear of prosecution and punishment from the state.ย 

Paxton and other Republicans stated that funding an out-of-state abortion can be punishable under a Texas law that dates back to the 1800s and indicated they are willing to prosecute abortion rights groups and others for helping accomodate one, Spectrum News reports.ย 

Republican state lawmakers against out-of-state abortions at odds with Justice Department

The Republican state lawmakers wanting to outlaw out-of-state abortions are currently at odds with the Justice Department, which has said they will defend a personโ€™s right to travel to another state to receive an abortion.ย 

A hearing to determine whether the Texas abortion rights groups will be granted a preliminary injunction is expected in the next few weeks, Spectrum News reports.ย 

In related abortion news, last month, police in Nebraska subpoenaed Facebook to gain access to Facebook messages that led to charges being filed against a women and her mother who allegedly had performed an illegal abortion.ย 

The charges were among the first to use private Facebook data as evidence since the Supreme Court overturned Roe v. Wade.ย 

Also last month, it was Bloomberg reported that anti-abortion group Heartbeat International has collected abortion data from pro-life resource centers for years.

Heartbeat reportedly uses software that is designed to be able to assess a โ€œclient-risk factorโ€ for the likelihood that a women will end up seeking an abortion.ย
