Birth control users say they experience pain after Essure placement claiming that the permanent, non-surgical birth control is defective in its design.

Essure was seen as an exciting new development in birth control options because it was the first form of non-surgical permanent birth control. This seemed like an appealing alternative to tubal ligation (having one’s tubes tied), because it is much less invasive.

However, Essure may have more drawbacks than benefits. Many patients have reported a range of serious adverse side effects and negative reactions to Essure. The pain after Essure placement reports include:

  • discomfort after Essure placement
  • rashes
  • bloating
  • allergic reaction
  • excessive bleeding
  • organ perforation
  • pelvic pain
  • miscarriage
  • ectopic pregnancy

Patients claim that they were not informed about these possible side effects, and instead were told that Essure was safe and effective.

What is Essure?

Essure is a form of permanent birth control that was first manufactured by the company Conceptus. It was then purchased by Bayer.

Unlike many forms of birth control, Essure is non-hormonal. Essure is also a permanent form of birth control.

The Essure device consists of two metal coils. in a non-surgical implantation process, the coils are inserted through the vagina and uterus, and are then placed in each fallopian tube. The device prohibits conception when the body forms tissues over the metal coils over the course of a few months.

Patients who have the Essure device implanted in their bodies must be evaluated by their doctors three months after implantation to ensure that the procedure work and that they can no longer become pregnant.

Essure Complications: Pain After Essure Placement and Others

Essure was approved by the U.S. Food and Drug Administration in 2002 through a fast-track approval process. Fast-track approval processes enable drugs and medical devices to be sold on the market without the normal pre-market testing. Critics say that in some cases, this can cause drugs and devices with serious side effects to reach the general public.

In the case of Essure, many women claim that the device did not receive enough testing before being released onto the market, and as a result, many patients were unnecessarily exposed to many dangerous side effects.

The FDA has received over 4,500 adverse events reports about negative reactions to Essure, including pain after Essure placement.

Many women claim that not only did Essure not receive enough testing before being released onto the market, but that it should not have been approved at all because of the pain after Essure placement experienced by so many patients. 

Essure Birth Control Lawsuits

Consumer Erin Brockovich is already leading a group of women in a fight against Essure’s approval. These women are requesting that the FDA pull the Essure device from the market in order to protect women from unnecessary dangerous side effects like pain after Essure placement.

An Essure lawsuit against Bayer argues that that the “premarket approval” that was given to Bayer for Essure is inappropriate. This premarket approval allegedly shields the company from proper product liability, enabling the company to continue to sell a dangerous product.

The pain after Essure placement lawsuit argues that the studies that were conducted on the device were flawed, and also argues that to avoid exposing patients injury, the device should have been subjected to more testing before being put on the market.

In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
