Wyndham timeshareThe plaintiff in a Wyndham timeshare class action lawsuit claims that opposing counsel has lodged a lawsuit against his attorneys in an attempt to intimidate.

Lead plaintiff Freddie Francy alleges in his class action lawsuit that Wyndham assessed a nearly $350 processing fee to him and other timeshare owners. Francy says that act entitles him and his proposed Class to exit their timeshare contracts.

Following Francy’s class action filing, Wyndham’s attorneys reportedly lodged a lawsuit against the firm in Florida federal court as an attempt to stop them from helping Francy and other timeshare owners.

“The Florida case, and others filed like it by attorney defendants, has been instigated for the improper purpose of intimidating those timeshare owners who dare to assert their legal rights and attorneys who assist defrauded timeshare owners into silence and inaction and fear of public participation, and to chill access to counsel and to the courts for victims of timeshare and travel club fraud,” contends the Wyndham class action plaintiff.

According to the Wyndham timeshare class action lawsuit, the addition of the processing fee is a violation of Missouri state laws and constitute a deceptive form of legal business.

Francy says that he and others entered into their Wyndham timeshare agreements as a result of high-pressure sales tactics and deceptive marketing. The timeshare presentation was so long, alleges the plaintiff, that he felt like he had to buy to get out of the meeting. He also says that he was told during a sales presentation that he would be able to sell his timeshare for a profit.

“Plaintiff was detained at the sales presentation against his will for a lengthy period of time,” alleges the Wyndham class action lawsuit.

“The extended, unreasonable, lengthy time period of the sales presentation constituted duress and coercion to force plaintiff to make a purchase before he was allowed to leave the premises.”

According to the Wyndham timeshare class action lawsuit, Wyndham along with its counsel, have preyed upon the elderly and less sophisticated buyers to wring billions in profits in exchange for “worthless” timeshares, vacation points, and memberships in travel clubs.

The plaintiff contends that Class Members like him have been financially ruined by Wyndham timeshares, left unable to pay other bills and harming their credit scores.

Francy demands a full refund of his timeshare contract which is more than $134,000.

    My property in Hawaii has now been taken away due to a system update in August and now Wyndham says I need to buy more points if I want to ever go back. I was Silver VIP now I am not because they cut bi-annual owners points in half even though we only have access every other year.

    My husband and I was pressured into buying an unwanted Worldmark by Wyndham vacation package while we were intoxicated in Las Vegas during a couples vacation. We were told it would only be 90 minutes but we were there for over 4 hours. Was told that we would be able to travel anywhere anytime untrue majority of the resorts weren’t available and were always booked and not an option for TravelShare. We were also told that we could get out of our TravelShare at anytime unlike a timeshare also another lie. In addition they give you a 10 day grace period to rescind your offer and exit your contract but it takes 14-21 days to even get the information for membership login to access your owners handbook. So by the time you get the necessary information your grace period is gone. But even if you call immediately you are given the run around through several departments for owner care, to the loan dept., owner services, to the exit dept. and no one knows anything and no one can help and you’re going to keep being transferred playing phone tag and be in an endless circle trying to get out. Then they try to get you to add more credits or sell/transfer it to someone else instead of letting you out of your contract during the allotted time period. They are strong arming you to have to file bankruptcy, affect your credit, or just going for broke trying to maintain and pay. I want to be added and if I can’t be added I want to know I how I can file a new class action suit because these is not acceptable to misrepresent information and hold people against their will when wanting to leave their contract.

      My situation is exactly the same with one exception, I was told by the sales team at National Harbor in Maryland that my original contract which I purchased in Atlantic City, NJ had to be voided because the program was no longer available and they could put me in a better contract. Original contract purchased was never received by myself, vacation ownership shows the contract in the system but cannot locate the original, and when I reached out to the person who told me at the National Harbor resort to reach out to him for anything is not returning emails. To add insult to injury, I now am paying maintenance fees for two contracts, one of which isn’t supposed to exist. I wasn’t informed of the rescission period until I reached out about 3 weeks after I signed.
      The other concern I have is why I had to set through 2 presentations within a 30 day time period.
      If possible, I want to be added to this class action suit as well.

    Please contact me as soon as you have the time to do so as I have a nightmare time share that is costing me everything I have. Have all paperwork that you would need. The time shire place is Tahiti Village in NV. Hope you can help end this nightmare I am stuck in.

    Yes! Please enter us. We have ALL KINDS of stories since we have been owners,over 10 years. Bought Wyndham when it was Fairfield as well. All of the above is true plus more!!! There has got to be some legal action taken toward timeshare companies, what they are doing is a CRIME! We have been treated terrible and we have purchased 3 times!!!!

    I owned Worldmark fee and clear for over 20 years we went to Vegas and were told we needed to go to an owner update and that we had to get a travel share program and then a credit card that would end up covering our maintenance dues all lies when we got home the only thing they did was attached our paid off timeshare to a new one and now they are charging us 100.00 a month and they we own nothing they are wrecking our credit I was just declined our refinance due to them reporting we are over 500 days late in paying. PLEASE CONTACT ME I WILL GIVE YOU ALL THE DOCUMENTATION YOU NEED. PLEASE HELP US

    Please add me to the lawsuit….I was told that I would only need to listen to a presentation that would take 1 hour. None of these things were true. I was intimidated and forced to sit for hours, pushed to sign papers and not given truthful information. The shuttle left me stranded miles away from my hotel. I had to sit for an extended period of time which caused fear, intimidation, hunger, and exhaustion. I told the Wyndham salesman that I felt like I was being scammed and taken advantage of and wanted to leave because my family was waiting at the hotel for me. I asked if I would be able to cancel the process. He stated to me – “I can’t tell you that.” I asked why and he repeated “I just can’t tell you that” I feel this was deceitful and criminal. I also received a credit card from Barclay when I returned home. I was not informed that I would be applying for a “Barclay credit card” as part of the sale. I also later learned that the Timeshare is “perpetual” and will be inherited by my now minor children.

    I have called Wyndham on several occasions to report my encounter at the Wyndham Las Vegas sale and ask for help. Every time I call I am told something different, receive no help and Wyndham asking for more money to upgrade and telling me not to reach out to any Timeshare cancellation agents. I was even told by a man named Andrew Knowles from Wyndham that the burden of proof was on me that this was deceitful and inappropriate sales practices

    We are now in the midst of a Global Health Pandemic. I am not able to travel. I am also not able to pay for a Timeshare. Traveling to most states requires 14 day quarantine and 14 day quarantine upon my return to my home state. I have not been been able to book anything. As a single mom, I can’t afford this. I was not given truthful and accurate information. Please add my to the lawsuit

    Please add me too. I am still be charged fees and making payments but can’t talk to someone about my points. There are several places I have tried to contact Wyndham to rent or utilize my points. I am told I am not eligible for certain resort. And the financing is outrageous which they don’t explain. I want out of my timeshare but they say you can’t sell them but will they buy it back

    Please add me and my husband. We were held in a meeting that lasted over 5 hours, were told about all the resort options and ease of use. Then when I tried to book they gave priority to world mark owners and I was left with little to no options in some places. Not to mention you have to book nearly a year in advance. Showed up to one resort with a surprise $500 fee. Get constant phone calls harassing me to upgrade and they did a hard inquiry on my credit for no reason as I’m not buying more points. We bought in Nevada but reside in Washington.

    Purchased Wyndham when it was still Fairfield in 2006. Never was able to use. Racked up maintenance fees. Ended up getting foreclosed without notification. Basically paid for 13 years for something I pressured into purchasing I never even used.

      Never received any notice of foreclosure. Paid our timeshare in full but Wyndham foreclosed our timeshare via a public auction for $100. Sickening! We our $65K only to lose our timeshare and never received notice.

    I already had Wyndham and do the health issues wanted to use my buyback. Instead of doing that which I didn’t even know at the time they added another $350,000 to my contract instead of reducing it so it was up to $750,000 and I had already spent a bunch on it my husband with kidney failure and I have three autoimmune diseases and other things and we kept telling them we needed to get back to our room so we can take our medicines so my husband could rest and they kept badgering us and instead of me ending up with a buyback I ended up with the extra on it. So I ended up having to drop all the contracts no vacations anymore and they ruined my credit I tried to go through them to get them to straighten out what they did and they refused to help me the agents use high Tech high tactic pushy sales tactics. They bully you into buying they tell you to lie as far as income and things like that and they lie to you just to make a sale. I had amazing credit before Wyndham they destroyed it.
