Marriott International and Kyo-ya Hotels & Resorts have agreed to a $1.825 million settlement benefiting former guests of certain Hawaii hotels.

The Class includes all residents of the United States or Canada who booked and paid for a stay at one of the following hotels on one or more dates between Oct. 8, 2018, and Nov. 27, 2018: 

  • The Royal Hawaiian, a Luxury Collection Resort
  • The Moana Surfrider, a Westin Resort & Spa, Waikiki Beach
  • Sheraton Waikiki
  • Sheraton Princess Kaiulani 
  • Sheraton Maui Resort & Spa

A strike that began Oct. 8, 2018, involved about 2,000 employees of the hotels covered by the settlement, according to the class action lawsuit. The workers had held a vote to strike on Sept. 10, 2018.

The class action had alleged Marriott International and Kyo-ya violated state law by unfairly or deceptively charging the amounts they were during the strike and failed to notify guests before they arrived that the strike would affect the hotels’ services and amenities.

Marriott International operates more than 7,000 properties across 30 brands in 131 countries and territories, according to the company’s website. Its portfolio includes brands such as Westin, Ritz-Carlton, and Renaissance Hotels, among others.

Kyo-ya operates six hotels and resorts in Hawaii and California, according to the the company’s website.

Marriott International and Kyo-ya have not admitted any wrongdoing; rather, both sides have agreed to the settlement to avoid the cost and uncertainty of continuing litigation.

After attorneys’ fees and other costs are paid, Class Members who file valid claims will be eligible for a share of the remainder of the settlement fund.

The amount each Class Member will receive will be based on the hotel at which they stayed, the duration of their stay, and the manner in which the stay was booked.

Class Members are expected to receive a gross payment of $24.90 per night, $51.29 per night, $12.45 per night, or $25.65 per night, depending on the above factors.

A final approval hearing in the Marriott International Hawaii hotels settlement will take place Oct. 1, 2021.

The deadline to opt out of or object to the settlement is Sept. 1, 2021.

The deadline to file a claim form is Aug. 3, 2021.

Who’s Eligible

All residents of the United States or Canada who booked and paid for a stay at one of the following hotels on one or more dates between Oct. 8, 2018, and Nov. 27, 2018:

Potential Award

Up to $51.29 per night.

  • The amount each Class Member will receive will be based on the hotel at which they stayed, the duration of their stay, and the manner in which the stay was booked.
  • Class Members are expected to receive a gross payment of $24.90 per night, $51.29 per night, $12.45 per night, or $25.65 per night.
Proof of Stay

Proof of stay is not required to submit a claim; however, the settlement administrator has the right to request verification or more information from a claimant.

    everybody complaining about not getting a check i can guarentee 98% of you never even stayed in those hotels lol. Trying to get free money and complaining isn’t gonna do you any good.

      Out of 13000+ claims only 2300 were approved. They were mailed out the 28th. If you have not yet received a check, you were likely denied.
