A new class action lawsuit alleges that Comcast Cable Communications violates the law by placing pre-recorded phone calls without consent through its Xfinity TV and internet service provider.ย
Plaintiff Travis Pondโs class action lawsuit claims Xfinity violates the Telephone Consumer Protection Act (TCPA) by placing pre-recorded debt collection calls to consumers through the U.S.
โUnfortunately, Xfinity places pre-recorded debt collection calls to consumers like the Plaintiff who have never done business with Xfinity,โ the Xfinity class action says.ย
Pond wants to represent a nationwide class of consumers who received a pre-recorded phone call from Xfinity within the last four years at a number not connected to an Xfinity account or an authorized representative.ย
Class action: Xfinity phone calls were intruding
Pond argues the allegedly unauthorized phone calls he received from Xfintiy harmed him in the form of annoyance, nuisance, invasion of privacy, occupied his phone memory, and โdisturbed the use and enjoyment of his phone.โย
โDespite his requests for the calls to stop, Plaintiff Pond continued receiving unwanted calls from Xfinity,โ the Xfinity class action says.ย
Pond claims he was able to tell the phone calls were pre-recorded, meanwhile, due to the voice sounding robotic, because he heard the same exact message on multiple calls and because he was not given a chance to speak to a human.ย
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual and/or statutory damages for himself and all class members.ย
Plaintiffs targeted Comcast Xfinity with a trio of class action lawsuits last year over claims revolving around an October 2023 data breach.ย
The class action lawsuits similarly argued Xfinity failed to properly secure the data of more than 36 million customers during the incident.ย
