Xfinity debt collection class action lawsuit overview:ย

  • Who: Plaintiff Travis Pond filed a class action lawsuit against Comcast Cable Communications LLC.ย
  • Why: Pond claims Comcast violated the Telephone Consumer Protection Act byway of pre-recorded debt collection phone calls sent to consumers from its TV and internet service provider Xfinity.ย
  • Where: The Xfinity class action lawsuit was filed in Georgia federal court.ย

A new class action lawsuit alleges that Comcast Cable Communications violates the law by placing pre-recorded phone calls without consent through its Xfinity TV and internet service provider.ย

Plaintiff Travis Pondโ€™s class action lawsuit claims Xfinity violates the Telephone Consumer Protection Act (TCPA) by placing pre-recorded debt collection calls to consumers through the U.S.

โ€œUnfortunately, Xfinity places pre-recorded debt collection calls to consumers like the Plaintiff who have never done business with Xfinity,โ€ the Xfinity class action says.ย

Pond wants to represent a nationwide class of consumers who received a pre-recorded phone call from Xfinity within the last four years at a number not connected to an Xfinity account or an authorized representative.ย

Class action: Xfinity phone calls were intruding

Pond argues the allegedly unauthorized phone calls he received from Xfintiy harmed him in the form of annoyance, nuisance, invasion of privacy, occupied his phone memory, and โ€œdisturbed the use and enjoyment of his phone.โ€ย

โ€œDespite his requests for the calls to stop, Plaintiff Pond continued receiving unwanted calls from Xfinity,โ€ the Xfinity class action says.ย

Pond claims he was able to tell the phone calls were pre-recorded, meanwhile, due to the voice sounding robotic, because he heard the same exact message on multiple calls and because he was not given a chance to speak to a human.ย

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual and/or statutory damages for himself and all class members.ย

Plaintiffs targeted Comcast Xfinity with a trio of class action lawsuits last year over claims revolving around an October 2023 data breach.ย

The class action lawsuits similarly argued Xfinity failed to properly secure the data of more than 36 million customers during the incident.ย

The plaintiff is represented by Avi R. Kaufman of Kaufman P.A and Tristan W. Gillespie.ย

The Xfinity debt collection class action lawsuit is Pond, et al. v. Comcast Cable Communications LLC, Case No. 1:24-cv-03553, in the U.S. District Court for the Northern District of Georgia.

Please add me. I have also purchased a NEW iPhone from Xfinity. I watched the unboxing of the phone and waited for them to transfer private information to the device. Later that night I received 5 threatening and profane calls from a person claiming that I have possession of their phone. I was accused of illegally obtaining that phone and illegal usage of it. Could Xfinity be selling REFURBISHED iPhones as NEW ones?
