UnitedHealthcare violates the law by allegedly placing pre-recorded calls to consumers without consent, a new class action lawsuit alleges.
Plaintiff Rob Binter Jr. claims UnitedHealthcare violates the Telephone Consumer Protection Act (TCPA) by allegedly placing pre-recorded marketing calls “often without the appropriate consent necessary to place such calls.”
Binter argues UnitedHealthcare “has a history” of placing calls to consumers who both are not current customers of the company and have not given it consent to call them.
“Plaintiff never provided consent for Defendant UHC to place prerecorded calls to his cell phone number,” the UnitedHealthcare class action states.
Binter wants to represent a nationwide class of consumers who, without giving consent, have received a phone call from UnitedHealthcare or a company calling on its behalf that used an artificial or prerecorded voice.
UnitedHealthcare phone calls all sound ‘scripted and automated,” says class action
The plaintiff argues he has received three pre-recorded phone calls from UnitedHealthcare this year, and says he knows they were pre-recorded because “they all sound scripted and automated, and other consumers have reported similar pre-recorded calls from United Healthcare.”
The pre-recorded phone calls allegedly placed by UnitedHealthcare caused Binter annoyance, were a nuisance, invaded his privacy, occupied his phone line and device, and “disturbed the use and enjoyment of his phone,” according to the UnitedHealthcare class action.
“Seeking redress for these injuries, Plaintiff Binter, on behalf of himself and Class of similarly situated individuals, brings suit under the TCPA,” the UnitedHealthcare class action states.
The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual and/or statutory damages for himself and all class members.
A separate class action lawsuit was filed against UnitedHealthcare last December over claims the provider made billions of dollars by collecting a “savings fee” from healthcare plans through “phantom savings” it claims to have obtained for its plan members.
