Trugreen Prerecorded Robocalls Class Action Lawsuit Overview: 

  • Who: Dominic Deramo filed a class action lawsuit against Trugreen, Inc. 
  • Why: Deramo claims Trugreen violates the Telephone Consumer Protection Act by placing prerecorded phone calls using an artificial voice without prior consent.
  • Where: The lawsuit was filed in New York federal court.

Trugreen, Inc. uses an artificial voice to place unsolicited, prerecorded phone calls to consumers without their consent, a new class action lawsuit alleges.

Plaintiff Dominic Deramo claims Trugreen violates the Telephone Consumer Protection Act (TCPA) by making the prerecorded robocalls advertising for its lawn care business. 

Deramo says Trugreen called him on his cellular and landline phone more than 20 times during the summer of 2021 despite him never doing business with the company or giving them consent to call him. 

Further, Deramo claims the telephone calls were placed using an artificial or prerecorded voice, which he never consented to. 

“Prior to the calls at issue in this action, Mr. Deramo had not had any contact with Defendant. He has never consented in writing, or otherwise, to receive calls using an artificial or prerecorded voice from Defendant,” the class action lawsuit states. 

Trugreen Would Need ‘Express Written Consent’ To Place Calls

Trugreen would need to acquire express written consent to make prerecorded phone calls, in accordance with the TCPA. 

“Defendant not only invades the personal privacy of Plaintiff and members of the putative Class, but also intentionally and repeatedly violates the TCPA,” the class action lawsuit states. 

Deramo claims Trugreen is not only guilty of violating the TCPA but also of knowingly and willfully doing so. He is demanding a jury trial and requesting injunctive relief along with statutory damages for himself and all class members. 

Deramo wants to represent a nationwide class of consumers who have received a prerecorded telephone call by or on behalf of Trugreen in the past four years. 

Earlier this month, a class of non-Citibank customers were given class certification to pursue their claims that the bank placed robocalls to them without their consent

Also this month, a class action lawsuit was filed against David’s Bridal by a consumer who argues the company sends unsolicited and unwanted text messages to consumers who have already opted out of receiving them.

    They Suck! Tim Sla will not communicate! The area beside what I have paid them for 2 years to maintain, looks 100x better and I take care of it.

    They billed for services NO ONE SHOWED up to provide. Then refused to refund and turned over to COLLECTIONS! They sent someone out to fertilize
    and instead, he killed everywhere he walked and sprayed, you could see his trail.
    And the robo calls and sales call continue weekly!

    Please add. They call me and I have never done business with em or consented to be called. I had to look them up to find out about them. You can imagine my disappointment when I found out it was lawn care and not something more herbal, lol.

    Not only has TG been relentless with robocalls for non-payment, they aree based on a service I didn’t request. Everytime I talk to someone and they seem to understand, nothing gets resolved. Now I have a collection company coming after me that doesn’t allow a response and simply directs me back to Trugreen.

    TruGreen has been unrelentless with phone calls. My caller ID shows different numbers, same company name.

    PLEASE ADD ME

    I have voicemail messages and text messages from robocalls!! I am STILL receiving these types of calls even AFTER I submitted copies of both on an open suit via this site. I have not heard anything as of yet. The types of calls that I am still receiving are about student loans, TruGreen, car warranties, and even final warnings for several debt collections (for whom I am not sure. I just know that it isn’t for me) Neither have I ever applied for nor received a student loan, never used TruGreen, or have outstanding debt!!!! and my car is paid for. How do these companies get away with these sorts of practices?

    I’m sick of them calling. I tried blocking each new number they used but they keep coming up with new numbers. I kept a recording of me telling them I didn’t want their service. If the class action is still available please add me.
