Cruise shipAccording to a recent lawsuit filed by a Texas man against Consolidated World Travel, the cruise line company may be violating the Telephone Consumer Protection Act by contacting consumers with promotions and advertisements without their consent.

Consolidated World Travel TCPA Lawsuit

According to Texas plaintiff Chris Cunningham, he began to receive unsolicited messages and calls from Consolidated World Travel on or about October 2015. Cunningham claims that the company negligently and willfully violated the Telephone Consumer Protection Act by contacting him with these promotions, as he is not a customer of the travel company.

The company alleged contacted Cunningham repeatedly, using an automated telephone dialing system to send him messages and make calls using a pre-recorded voice. According to the plaintiff, these calls were made in an attempt to solicit his business and encourage him to make purchases through the company.

In addition to the nuisance and invasion of privacy caused by these calls, Chris claims that he was charged for these incoming calls and spam texts. Additionally, Cunningham claims that he never provided his phone number to the company, and did not give his explicit consent to be contacted.

The class action lawsuit against Consolidated World Travel covers anyone who was illegally contacted by the company through an automated telephone dialing system using an artificial voice during the four years prior to his complaint being filed. While it is unknown how many consumers may have received unsolicited messages or phone calls from Consolidated World Travel, the class action lawsuit against the company estimates that thousands of people may qualify to join the suit.

About Unsolicited Messages and the TCPA

Consumers who have received unsolicited messages, calls, or voicemails from companies advertising their goods, services, sales, or coupons may have rights under the Telephone Consumer Protection Act. The TCPA was established in order to protect consumers from being harassed by businesses.

According to the TCPA, businesses must follow several rules in order to contact consumers about their products or services. It is illegal for a company to contact you using an automated telephone dialing or texting system using pre-recorded or pre-written messages unless you have given your prior express consent for them to do so.

Additionally, businesses are prohibited from calling consumers too early in the morning or late at night, or calling numbers listed on the National Do Not Call Registry. Companies are also required to keep records of their own company-specific do-not-call lists and abide by them. Even if consumers have given their consent to be contacted by a business using an automated dialing or texting system, companies must allow them to opt-out and revoke consent.

If you have been sent unsolicited messages by a company using an autodial or texting system, you may qualify to join a class action lawsuit regarding TCPA violations. TCPA violations may be punishable by up to $1,500 per offense, meaning that victims may be able to collect significant compensation for these intrusions of privacy.
